CONDITIONS OF ISSUE AND USE FOR EZ-LINK INTEGRATED SEASON PASS

These Conditions shall be binding on you, upon the issuance of a weekly or monthly Season Pass, or a weekly or monthly Enhanced Season Pass (collectively referred to as “Season Pass”). These Conditions govern the possession and use of the Season Pass.

All Season Passes are issued by EZ-Link Pte Ltd (“EZ-Link”) and subject to these Conditions which shall be binding on all persons to whom a Season Pass has been issued. The purchase of the Season Pass and/or the subsequent use thereof by you shall be deemed to be acceptance by you of these Conditions.

Before you may purchase a Season Pass, you must first possess a personalised adult ez-link card (“personalised card”) issued to you by EZ-Link for the Season Pass scheme. You may apply for the personalised card from EZ-Link at TransitLink ticket offices, EZ-Link’s website at www.ezlink.com.sg or through such other channels as may be permitted by EZ-Link. EZ-Link will charge a $5.00 Card Fee plus a $3.00 Personalisation Fee for the issuance of the personalised card. You will be required to deposit onto your personalised card an initial minimum stored value of such amount as may be determined by EZ-Link. The application for the personalised card is to be completed with such particulars as may be required by EZ-Link from time to time. EZ-Link reserves the right to reject applications for the personalised card if information provided is unclear or incomplete.

You may purchase a weekly Season Pass or a weekly Enhanced Season Pass that is valid for a period of 7 days, or a monthly Season Pass or a monthly Enhanced Season Pass that is valid for a period of 30 days. The Season Pass can be purchased up to 7 days in advance of the intended start date, and the next Season Pass can be purchased up to 7 days in advance before the expiry of the previous Season Pass.

You may purchase a Season Pass from TransitLink Ticket Offices or any other authorized sales outlets.

Upon the purchase of a Season Pass, the Season Pass will be encoded onto your personalised card. You may use the Season Pass for travel only on trunk, feeder and intra-town bus services operated by SBS Transit Ltd and SMRT Buses Ltd (“basic bus services”), and all rapid transit system services by SBS Transit Ltd, SMRT Light Rail Pte Ltd and SMRT Trains Ltd (“rail services”). The Season Pass is not valid for travel other than on basic bus services and rail services.

The weekly or monthly Season Pass is valid for unlimited trips on basic bus services and up to a maximum of 4 trips on rail services per operating day. The weekly or monthly Enhanced Season Pass is valid for unlimited trips on both basic bus services and rail services during the validity period. Any travel beyond the daily maximum of 4 trips on rail services for the weekly or monthly Season Pass will incur adult fare deductions from the stored value of your personalised card.

The Season Pass will not be valid for use on bus services without a minimum stored value. To enable use of the Season Pass and commence your journey on bus services, you are required to maintain on your personalised card a minimum stored value of an amount no less than the full adult fare applicable from the stage of boarding to the last stage of the bus trip. For your convenience, you may wish to maintain a stored value of at least $3.00 at all times on your personalised card.

While you will still be able to use your Season Pass for rail services even though you may not have any remaining stored value on your personalised card. You are advised to tap in and tap out at the rail faregates to avoid any inconvenience.

To use your Season Pass on basic bus services, you must tap your Season Pass upon entry on the reader installed on the bus and to tap your Season Pass upon exit. If you do not tap your Season Pass upon exit, your Season Pass will not be valid for use and you will be charged an administrative fee (“Administrative Fee”) equivalent to the adult fare from the stage of boarding to the last stage of the bus trip. The Administrative Fee will be automatically deducted from the stored value of your personalised card.

If the Administrative Fee is inadvertently deducted due to no fault of yours, you may apply to EZ-Link to waive the Administrative Fee. EZ-Link will investigate and may waive and refund you the Administrative Fee on a case-by-case basis at its sole discretion.

The Season Pass is strictly personal and non-transferable. EZ-Link, any public transport official (as defined in the Public Transport Council Act, Cap 259B) or any person authorised by EZ-Link may confiscate the Season Pass if it is found being used by any person other than you. You shall not be entitled to refund or compensation of consequential loss of use in the event that the Season Pass is retained or confiscated.

You agree –(a) to comply with all the notices, guidelines, rules and instructions pertaining to the use of the Season Pass as issued by EZ-Link from time to time, including operating rules and/or policies that may be published from time to time by EZ-Link;
(b) not to allow or permit any other person to use the Season Pass for any reason whatsoever;
(c) to produce the Season Pass for inspection when requested by any public transport official, or any SBS Transit or SMRT staff;
(d) to abide by all applicable laws and regulations in the use of the Season Pass;
(e) not to tamper or allow anyone to tamper with the Season Pass;
(f) not to intentionally deface, damage and/or destroy the Season Pass;
(g) not to affix, print, attach and/or place any markings, stickers, objects and/or any other material onto the Season Pass or to otherwise alter, remove and/or replace any photographs, notices, trade marks, trade names, logos, artwork or designs on the Season Pass.

If your personalised card is corrupted due to no fault of yours, you may obtain a free replacement card by surrendering your corrupted personalised card. You will receive a refund of any partially used or unexpired Season Pass, which shall be pro-rated based on the date the refund was made. You will also receive a refund of the remaining stored value (if any) on the personalised card.

Other than as provided in paragraph 14, you are not entitled to a refund or partial refund for any partially used or unexpired Season Pass.

You are not entitled to a refund or partial refund for any partially used or unexpired Season Pass in the event your Season Pass is lost or stolen. You may apply for a replacement Season Pass upon payment of the $5.00 Card Fee and $3.00 Personalisation Fee. In the event your Season Pass is lost or stolen, you may wish to check if you are covered under any insurance policy (whether taken out by EZ-Link or yourself) covering your Season Pass, and if so, to claim for the refund for any partially used or unexpired Season Pass from the insurance company and/or the cost of the personalised card, as the case may be. You are advised to check the terms of the insurance policy (if any) and you should report to the police the loss or theft of your Season Pass within 24 hours from time of occurrence, otherwise you may be disqualified from claiming from the insurer.

Notwithstanding Clause 16, in the event that the Season Pass is lost or stolen, you are to inform EZ-Link at soon as practicable to enable the lost or stolen card to be blacklisted. When the lost or stolen card has been blacklisted, EZLink will refund you the remaining stored value, if any. EZ-Link’s determination of the remaining stored value on the lost or stolen card shall be final, save for manifest error.

Upon the expiry of the Season Pass, you may continue to use your personalised card as a normal adult ez-link card provided that you have sufficient stored value for payment of your trips.

Notwithstanding anything to the contrary contained herein, EZ-Link shall not be liable, whether or not arising out of the negligence of each of EZ-Link, its respective officers, employees, or agents, for any losses, damages, expenses, claims, liability and costs (including cost on a solicitor and client basis) that you may incur or suffer in connection therewith.

EZ-Link may from time to time amend any part of these Conditions. EZ-Link will give notice of any amendment by posting the same at its website at www.ezlink.com.sg, any TransitLink Ticket Office at MRT stations and bus interchanges or such other premises as may be determined by EZ-Link. An advisory note will be published on EZ-Link’s website one month before the commencement of any amendment. You agree that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If you do not accept any amendments, you shall cease all use of the Season Pass. Your continued use after the date of such notification shall constitute an affirmative acknowledgement by you of the amendments and shall be deemed to be acceptance of such revised Conditions.

No failure or delay on the part of EZ-Link in exercising any power, right or remedy under these Conditions shall operate as a waiver of such power, right or remedy.

A person or entity who is not a party to these Conditions shall have no right under the Contracts (Rights of Third Parties) Act, chapter 53B of Singapore to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Conditions.

EZ-Link shall not be liable for non-performance, error, interruption or delay in the performance of its obligations under these Conditions, in the Season Pass operation, if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:- (i) flood, lightning, acts of God, fire, earthquakes and other natural disasters; (ii) judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; (iii) power failure; (iv) acts or defaults of any telecommunications network operator; (v) circumstances where communications lines and/or computer systems of EZ-Link and/or the public transport operators cannot be used for reasons attributable to third party telecommunications carriers; and (vi) acts or omissions of the public transport operators or any party for whom EZ-Link is not responsible.

You hereby undertakes and agrees to indemnify EZ-Link from and against all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs (including without limitation, legal costs of EZ-Link on a solicitor and own client basis), awards, damages, losses and/or expenses however arising directly or indirectly by reason of and/or as a result of any breach or non-compliance by you of the terms and conditions herein.

The construction, validity and performance of these Conditions shall be governed by and construed in accordance with Singapore law. Each party mentioned herein hereby submits to the non-exclusive jurisdiction of the Singapore courts.
