EZ-Link Cards

CONDITIONS OF ISSUE AND USE FOR EZ-LINK CARD

These Conditions shall be binding on all persons (“Customer“) to whom EZL has issued an ez-link card (”ez-link Card“) as well as any Customer who purchases or otherwise procures and uses an ez-link Card.  These Conditions are published by EZL jointly with Citibank and govern the possession and use of the ez-link Card that may be used to effect transactions.

These Conditions shall also govern the purchase and use of any Form Factor sold or distributed by EZL or any party authorized by EZL, and/or the subsequent use thereof by the Customer shall be deemed to be acceptance by the Customer of these Conditions and any revisions to these Conditions.

ISSUANCE OF EZ-LINK CARD

  1. The ez-link Card is issued by EZ-Link Pte Ltd (“EZL”).
  2. EZL is the party that issues the ez-link Card, and Citibank Singapore Limited (“Citibank”) is the Bank appointed by EZL to safeguard the monies deposited by Customers into the ez-link Both EZL and Citibank have undertaken to be fully liable to Customers for the monies in the ez-link Card.
  3. EZL operates the ez-link Card in respect of the Customer’s use of the ez-link Card in accordance with these Conditions. The ez-link Card is distributed by EZL and/or EZL’s agents (“Agents”). The money advanced by the Customer for the ez-link Card or for topping up of the ez-link Card, as the case may be, is collected by EZL and/or the Agents for and on behalf of EZL.
  4. For the purposes of these Conditions:-“Bank” shall mean the bank appointed by EZL to undertake to be fully liable for the monies on the ez-link Card, and for the purposes of these Terms and Conditions shall refer to Citibank Singapore Limited.“ez-link Card” refers to a Form Factor which is linked and can be used to access a Wallet, and which are sold or made available under EZL’s brand name “ez-link” that allows the Customer to make payment transactions at Qualified Merchants,“Form Factor” shall mean any ez-link Card in any form, whether physical or virtual, which is sold or made available under EZL’s brand name “ez-link”, whether sold by EZL or its authorized parties, whereby Customer can access the Wallet in order to make payment of Qualified Goods and Services, as allowed by EZL.  The Form Factor shall include but is not limited to e-wallet, cards, mobile SIM cards, novelty pieces, mobile communication devices and other electronic devices.“monies” shall mean the monies paid for and/or stored in a Wallet (or the residual value remaining therein from time to time) linked to an ez-link card, which value shall not at any time exceed S$500 or such other amount as EZL may stipulate from time to time. This excludes the cost of any Form Factor.“Qualified Goods and/or Services” shall mean the goods sold and/or the services rendered by Qualified Merchants.“Qualified Merchants” shall mean persons approved by EZL to be engaged in the sale of the Qualified Goods and/or the provision of Qualified Services.  Qualified Merchant shall be authorized by EZL to accept the ez-link Card as a means of payment for such Qualified Goods and/or Services and may include but not be limited to public transport operators licensed by the relevant authorities in Singapore (“Transport Operators”).“Wallet” refers to a stored value account issued by EZL which can be accessed using an ez-link Card.

CONDITIONS OF USE

  1. All ez-link Cards are issued subject to these Conditions which shall be binding on all Customers.
  2. The Customer agrees :- (i) to comply with all the notices, guidelines, rules and instructions pertaining to the use of the ez-link Card as issued by EZL from time to time, including operating rules and/or policies that may be published from time to time by EZL; (ii) to abide by all applicable laws and regulations in the use of the ez-link Card; (iii) not to tamper or allow anyone to tamper with the ez-link Card; (iv) to use the ez-link Card only as a means of payment for Qualified Goods and/or Services; (v) not to intentionally deface, damage and/or destroy the ez-link Card; (vi) to take proper care of any ez-link Card and not to alter, remove and/or replace any notices, trademarks, trade names, logos, artwork or designs on the ez-link
  3. The Customer acknowledges that EZL is the issuer of the ez-link Card and the corresponding Wallet linked to it, and shall hold and be fully liable for all monies deposited by the Customer, and be responsible to the Customer for refunds of any monies when the Customer makes a request for refund. EZL shall meet the Customer’s redemption by making payment to Qualified Merchants who have provided Qualified Goods and/or Services to the Customer. EZL shall be responsible to the Customer for all administrative matters relating to the ez-link Card as contemplated under these Conditions, and EZL may appoint Agents to carry out such functions on its behalf.
  4. The Customer also acknowledges Citibank has undertaken to be fully liable as the Bank to the Customer in respect of monies in the ez-link

VALIDITY OF THE EZ-LINK CARD

  1. An ez-link Card is valid for use for 5 years from the date that it is encoded for use by EZL (the “Validity Period”), and thereafter the ez-link Card shall expire (“Expiry Date”).  The validity of the ez-link Card may also be shorter or longer than 5 years as may be notified by EZL to the Customer at the point or sale of any ez-link Card in any product packaging or otherwise at the point of issuance of the ez-link Card.  EZL may in its discretion and from time to time extend the Validity Period for any or all types of ez-link Cards.
  2. EZL may at its discretion blacklist any ez-link cards:
    1. the ez-link Card is suspected of being counterfeited, stolen, lost, tampered with or fraudulently issued or procured; or
    2. the monies have been fraudulently or illegally revalued or otherwise accessed; or
    3. the ez-link Card is or are otherwise suspected of being faulty, damaged or invalid for use.
  3. Where any ez-link Card has been blacklisted, the Customer shall not be entitled to use the ez-link Card, and the monies shall not be refunded to the Customer except with the approval of EZL.

TRANSACTIONS USING THE EZ-LINK CARD

    1. The ez-link Card shall and can be used as a means of payment for Qualified Goods and/or Services, subject always to these Conditions.
    2. EZL and/or the Qualified Merchants may reject the use of the ez-link Card for payment of Qualified Goods and/or Services if:-
      1. there is insufficient funds; or
      2. the Validity Period of the ez-link Card has expired; or
      3. the ez-link Card is or are otherwise suspected of being faulty, damaged or invalid for use.
      4. the ez-link Card is suspected to have been fraudulently issued, stolen or tampered with or may in any way pose a risk to the ez-link Card system; or
      5. the ez-link Card system is unable to process the payment for any reason whatsoever or if a force majeure event (see paragraph 16) arises which disables and/or prevents the Qualified Merchants from accepting and/or processing the ez-link Card as a means of payment.
    3. The Customer agrees that each of the Qualified Merchants is responsible for deducting payment for Qualified Goods and/or Services that the Customer has agreed with the Qualified Merchant or is agreeable (with the Qualified Merchant) to pay from the ez-link Card, in such manner as may be required by such Qualified Merchant.
    4. The Qualified Merchants accepting the use of ez-link Card may be changed from time to time without prior notice.
    5. Where an ez-link Card which was previously blacklisted (pursuant to paragraph 3.2), is subsequently removed by EZL from the blacklist after the reason for the blacklist has been resolved to EZL’s satisfaction, such ez-link Card may still be temporarily unavailable for use pending the ez-link Card system update, and the Customer agrees and understands that EZL shall not be liable for the non-availability of the ez-link Card during such period.

QUALIFIED GOODS AND/OR SERVICES OF QUALIFIED MERCHANTS

It is expressly acknowledged by the Customer that neither Citibank, EZL nor any Agent is involved in the provision of the Qualified Goods and/or Services offered by any Qualified Merchant accepting the ez-link Card for payment. Neither Citibank, EZL nor any Agent shall be liable in any way for the Qualified Goods and/or Services sold, rendered or provided by the Qualified Merchants (including without limitation any defect, disruption, failure or unavailability of or relating to any of such Qualified Goods and/or Services, as the case may be) or for any other disputes concerning the Qualified Goods and/or Services, all of which shall be the sole responsibility of the Qualified Merchants.

REFUNDS ON THE EZ-LINK CARD

  1. Subject to paragraphs 3 and 6, a refund of the monies remaining (whether valid or expired) can only be obtained by a Customer if the ez-link Card is presented at any Ticket Office at MRT stations and bus interchanges or at such other places or via such other channels as may be designated or authorized by EZL. Refunds may also be effected through such online means as may be determined by EZL. Customers may refer to the EZL website at ezlink.com.sg for the refund channels available. The amount of monies remaining (whether valid or expired) shall be as determined by EZL and/or the Agents and will be refunded free of interest. The ez-link Card shall be returned to the Customer after refund. Notwithstanding the foregoing, EZL or its Agent may require the ez-link Card to be retained for investigations to determine the value of the remaining monies.  Where a refund request requires EZL to conduct investigations, the remaining monies will be refunded upon completion of the investigations.  The remaining monies will be determined based on EZL’s system records. However, no refund of the monies will be made on any expired ez-link Card after 7 years from the Expiry Date whereupon the Customer shall have no claim against Citibank and/or EZL in respect of the monies remaining, whereupon EZL shall be fully entitled to deal with any unclaimed monies as it thinks fit.
  2. Other than as provided in paragraph 6.1 above, neither EZL nor any of the Agents shall be obligated to make a refund to any Customer or to process any Customer’s request for refund on any ez-link Card (whether valid or expired). Notwithstanding the foregoing provision, each of EZL and the Agents may at their absolute discretion make a refund or process a refund in respect of the monies or any part thereof, and any such refund may be made and/or processed subject to conditions imposed by EZL and/or the Agents on EZL’s behalf. EZL and/or the Agents shall not be obliged to effect an immediate refund, and may, in its absolute discretion, refund the monies on any ez-link Card in such manner and upon due verification as it deems fit.
  3. In any case, each of EZL and the Agents will not be liable to make a refund of the monies if :-
    1. the ez-link Card is not surrendered by the Customer at the time of a request for refund or the Customer is otherwise not able to establish proof of ownership; or
    2. the data on the ez-link Card is erased wholly or in part, or otherwise altered or interfered with as determined by EZL and/or the Agents; or
    3. the ez-link Card’s electronic data and its external card number are not available or reliably readable for any reason whatsoever as determined by EZL and/or the Agents; or
    4. the ez-link Cardis faulty, damaged or invalid such that EZL and/or the Agents is unable to read or access the data; or
    5. the ez-link Card is counterfeited, stolen, lost, tampered with or fraudulently issued or procured; or
    6. the monies is suspected by EZL to have been fraudulently or illegally revalued.
  4. A Customer shall be entitled to a refund of the monies at any time up to 7 years from the Expiry Date, PROVIDED that where the request for refund was made more than 2 years after the Validity Period, EZ-Link shall be entitled to levy a monthly service charge (“Refund Service Charge”) of S$1.00, for each card that is surrendered for refund more than 2 years after the Expiry Period. The Refund Service Charge shall be deducted monthly from the remaining monies commencing 2 years from the Expiry Period until request for refund is made or when the remaining monies is fully depleted, whichever is the earlier.  For the avoidance of doubt, the Customer shall not be entitled to a refund after 7 years from the Expiry Date.
  5. A Customer who makes a request for refund at the designated places referred to in paragraph 6.1 above shall, upon request, produce such identity document for inspection to verify the identity of the Customer. Each of EZL and the Agents may at their absolute discretion refuse any request for the refund of the monies, if the Customer does not produce his/her identification.
  6. The Customer shall, upon receipt of the refund, be deemed to have accepted the amount thereof as correct, and agrees to discharge each of Citibank, EZL and the Agents from any liability whatsoever to the Customer, including but not limited to any shortfall or error in the amount of such refund.
  7. Where the Customer has made a request for refund, and EZL and/or the Agents is required to effect a deferred refund of the remaining monies, EZL and/or the Agent may stipulate a refund collection period of not less than 90 calendar days for the Customer to or collect his refund.  In the event that the Customer fails or neglects to collect his refund or is otherwise unable to produce proof of the request for refund within the stipulated refund collection period, the Customer shall be deemed to have abandoned his claim to the refund and shall have not further right to claim against EZL for the refund.  EZL shall thereafter have the right to deal with the refund as it deems fit.
  8. All obligations of Citibank hereunder are payable solely at and by Citibank in Singapore, subject to the laws of Singapore (including any governmental actions, orders, decrees, and regulations).

DETERMINATION OF VALUE IN WALLET

The determination by EZL and/or the Agents as to the remaining monies on a Wallet shall be final and conclusive. For the purpose of such determination, the remaining monies as determined by EZL and/or the Agents from the records of EZL or the information generated by the ez-link Card system shall, save for manifest error, be deemed to be conclusive and binding against the Customer.

TERMS RELATING TO SALE AND USE OF EZ-LINK CARD

EZ-LINK CARD COST

  1. EZL or its agents or resellers may collect an amount to cover the cost of the ez-link card (“ez-link Card Cost”). The ez-link Card Cost, in the case of a physical card is up to a maximum of S$5.00. The ez-link Card Cost is non-refundable.
  2. EZL or its agents or resellers may collect from the Customer such amount higher than S$5.00 for the purchase of an ez-link card or other Form Factors.

REPLACEMENT OF DEFECTIVE EZ-LINK CARDS

  1. Subject to paragraphs 9.2, 9.3 and 9.4 below, a Customer may replace a defective ez-link Card by presenting it at any Ticket Office at MRT stations and bus interchanges. The monies in the Wallet on the defective ez-link Card shall be refunded to the Customer in accordance with paragraph 6. EZL may specify a minimum amount to be deposited for the Customer to be entitled to receive the replacement Form Factor. The defective ez-link Card shall be surrendered to and retained by EZL and/or the Agent upon such request for replacement.
  2. Other than as provided in paragraph 9.1 above, neither EZL nor any of the Agents shall be obligated to replace any ez-link Card (whether defective or not). Notwithstanding the foregoing provision, each of EZL and the Agents may at their absolute discretion replace the ez-link Card, and any such replacement may be made subject to conditions imposed by EZL and/or the Agents on EZL’s behalf.
  3. In any case, each of EZL and the Agents will not be liable to replace the ez-link Card for free as provided in paragraph 9.1 if:-
    1. the ez-link Card is not surrendered by the Customer at the time of request for replacement; or
    2. EZL and/or the Agents in its discretion determine that the ez-link Card has been damaged whether intentionally or by failure to take proper care of the ez-link Card or otherwise used or handled in breach of paragraph 2.2 herein; or
    3. the ez-link Card has been de-laminated, peeled, tampered, broken or otherwise damaged due to wear and tear; or
    4. EZL and/or the Agents are unable to reliably read or ascertain the identification account number associated with the ez-link Card for any reason whatsoever; or
    5. the Validity Period of the ez-link Card has expired.
  4. The determination by EZL and/or the Agents as to the amount of monies on a defective ez-link Card shall be final and conclusive (see paragraph 7 above). EZL reserves the right to subsequent adjustments to such determination should any transaction records received late indicate a different value than that determined at the time of replacement.

REPLACEMENT OF DEFECTIVE NON-CARD FORM FACTOR

EZL does not, unless otherwise expressly stipulated in the terms of sale, provide any product warranty for any Non-Card Form Factor. Where a Non-Card Form Factor purchased from EZL is defective (not through any fault or act of the Cardholder) prior or during the first use for payment or use of the Non-Card Form Factor, EZL or its agents or resellers shall replace the defective Non-Card Form Factor with a similar or like product. Subject to any prevailing law, EZL or its agents or resellers shall not be liable to replace any Non-Card Form Factor that is found to be defective at any second or subsequent use.

LOSS OF EZ-LINK CARDS

  1. Customers are responsible for safeguarding their against loss, damage or theft, and ensuring that their ez-link Card are not used by any person without the Customer’s permission. Each of Citibank, EZL, the Agents and the Qualified Merchants accepting the Form Factor for payment for Qualified Goods and/or Services are not responsible for any financial losses incurred due to the loss or unauthorized use of aN ez-link Card and have no obligation whatsoever to prevent the use of a lost ez-link Card by a person other than the Customer.
  2. Where EZL and/or the Agents are in possession of any lost ez-link Card, the Customer may reclaim the ez-link Card provided that the Customer is able to produce proof of ownership to the satisfaction of EZL and/or the Agents.  Customer shall not have any claim to any lost ez-link Card or the monies therein if the lost ez-link Card remains unclaimed after two weeks in EZL and/or the Agents’ possession. EZL shall be fully entitled to deal with the remaining monies on such lost Form Factor as it thinks fit.

EXCLUSION OF LIABILITY

  1. Notwithstanding anything to the contrary contained herein, each of Citibank, EZL and the Agents shall not be liable, whether or not arising out of the negligence of each of Citibank, EZL, the Agents and/or their respective officers, employees, or agents, for any losses, damages, expenses, claims, liability and costs (including cost on a solicitor and client basis) that the Customer may incur or suffer in connection with:-
    1. the use or issue of ez-link cards; or
    2. any delay in issuing of ez-link Card or suspension or discontinuance of issuing of ez-link Card;
    3. any period where any equipment, software or system is unavailable for processing the use of the ez-link Card for payment; or
    4. any delay or detention arising from use of the ez-link Card.
  2. Damaged or defective ez-link Card may not be accepted in the equipment used by the Qualified Merchants. Neither Citibank, EZL nor the Agents shall be liable for any loss, delay or inconvenience that may be incurred if the ez-link Card is not accepted in such equipment.
  3. Notwithstanding any other provision of these Conditions, EZL’s total liability to the Customer under these Conditions and at law shall not exceed in aggregate the sum of S$500.00 ez-link Card.
  4. Citibank’s and EZL’s total liability to a Customer shall not exceed the aggregate of the remaining monies of such Customer’s ez-link Cardt as of the date the Customer’s claim arises.

AMENDMENT

EZL may (for and on behalf of itself and/or Citibank) from time to time amend any part of these Conditions. EZL will give notice of any amendment by posting the same at its website at www.ezlink.com.sg, any Passenger Service Centre or Ticket Office at MRT stations and bus interchanges, the premises of the Agents and/or such other premises as may be determined by EZL. The Customer agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If the Customer does not accept any amendments, he shall cease all use of the ez-link Card. The Customer’s continued use of the ez-link Card after the date of such notification shall constitute an affirmative acknowledgement by the Customer of the amendments and shall be deemed to be the Customer’s acceptance of such revised Conditions.

NO WAIVER

No failure or delay on the part of EZL in exercising any power, right, or remedy under these conditions shall operate as a waiver of such power, right, or remedy.

RIGHT OF THIRD PARTIES

A person or entity who is not a party to these Conditions shall have no right under the Contracts (Rights of Third Parties) Act, chapter 53B of Singapore to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Conditions.

FORCE MAJUERE

Neither Citibank nor EZL nor any Agents shall be liable for non-performance, error, interruption or delay in the performance of their obligations under these Conditions, if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:- (i) flood, lightning, acts of God, fire, earthquakes and other natural disasters; (ii) judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; (iii) power failure; (iv) acts or defaults of any telecommunications network operator; (v) circumstances where communications lines and/or computer systems of EZL, Citibank, the Agents and/or the Qualified Merchants cannot be used for reasons attributable to third party telecommunications carriers; and (vi) acts or omissions of any Qualified Merchant or any party for whom Citibank, EZL and/or the Agents are/is not responsible.

INDEMNITY

The Customer hereby undertakes and agrees to indemnify each of Citibank and EZL and keep each of Citibank and EZL at all times fully indemnified from and against all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs (including without limitation, legal costs of Citibank and/or EZL on a solicitor and own client basis), awards, damages, losses and/or expenses however arising directly or indirectly by reason of and/or as a result of any breach or non-compliance by the Customer of the terms and conditions herein.

GOVERNING LAW

The construction, validity and performance of these Conditions shall be governed by and construed in accordance with Singapore law. Each party mentioned herein hereby submits to the non-exclusive jurisdiction of the Singapore courts.

TRANSIT CONDITIONS

  1. The use of the ez-link Card shall be subject to the Transit Conditions.
  2. EZL, the Transport Operators and/or the Agents shall be entitled without assigning any reason therefore to retain any ez-link Card which it reasonably suspects or has reason to believe to have been blacklisted, fraudulently issued, stolen, tampered with and/or used any personalized ez-link Card  (which was not issued to the person using such ez-link Card or which the person is not entitled to the use thereof, or where the ez-link Card has been blacklisted.

EZ-Link Wallet

These terms and conditions governing the use of the EZ-Link Wallet incorporate any other terms and conditions which may be expressly stated in the Terms governing the use of the EZ-Link App. If there is any conflict or inconsistency between these Terms and other terms and conditions, these Terms will prevail.

The EZ-Link Wallet is a stored value facility, where such stored value is capable of being used by the User (“you, your”) to perform purchases via QR Codes domestically in Singapore. Overseas usage may also be made available to you subject to further terms and conditions upon activation. You can also check the balance and view the transaction history of your EZ-Link Wallet from the EZ-Link App.

You acknowledge and agree that:

  1. EZ-Link is not held responsible or liable for any wrongly configured purchases, whether of purchase value or recipient, and that the amount of remaining value on the EZ-Link Wallet at any point in time shall be conclusive of the remaining value, save for any adjustments as may be performed by EZ-Link due to any system errors;
  2. Various limits have been implemented to safeguard the potential losses and you are aware that:
    i. Maximum amount the EZ-Link Wallet can contain at any time is S$500;
    ii. Any configured top-up amount that will cause the EZ-Link Wallet balance to exceed the maximum stored amounts that you are entitled to will automatically block the top-up and trigger an error message.
  3. EZ-Link Rewards points are available for both local & overseas usages on the EZ-Link Wallet
    1. Transactions which are cancelled are not eligible for EZ-Link Rewards points
  4. The EZ-Link Wallet may only be used to pay at selected participating merchants which display the QR Code indicating acceptance of EZ-Link Wallet. EZ-Link reserves the rights to add or remove participating merchants to the list from time to time without further notice to you.
  5. In order to use the EZ-Link Wallet, you must register as a user on the EZ-Link App, and you shall consent to allow us to collect, use, and store your personal information in order to identify you and provide relevant customer service in relation to the EZ-Link Wallet. You shall also consent to allow us to make available your personal information to third parties service providers engaged by us in relation to the EZ-Link Wallet services. In the event that you are eligible for any upgrade of your Wallet account, you also consent for EZ-Link to make such upgrades to your Wallet automatically and consent to provision and utilization of your personal information by EZ-Link in order to comply with any regulations in accordance with local legislation.
  6. You acknowledge that EZ-Link does not warrant that the EZ-Link Wallet will be available at all times, and EZ-Link shall not be liable for any loss as may be suffered by you arising from you not being able to use the EZ-Link Wallet.
  7. All payment amounts shall be denominated in Singapore dollars. If any amount specified by you to be paid to the relevant merchant under a payment transaction request is denominated in any currency other than Singapore dollars, EZ-Link shall be entitled to convert the amount into Singapore dollars at foreign exchange rates which are determined by any payment network and/or EZ-Link as the case may be, and such converted amount including any additional fees and charges that may be imposed by EZ-Link in accordance with these Terms.
  8. In the event your payment through the EZ-Link Wallet is made to an overseas merchant offering goods or services through QR Code payment, and the payment is later invalidated for any reason including, but not limited to claims, chargebacks, or if there is a reversal of the payment, you continue to be liable to EZ-Link for the full amount of the payment in addition to any fees. You agree to allow EZ-Link to determine (or in the case where a debit or credit card is used as the source of funds, to work with your debit or credit card issuer) to, where applicable, determine the appropriate party to incur the burden of such claims, chargebacks or reversals and where applicable to recover any amounts due to EZ-Link by debiting your EZ-Link Wallet.
  9. Refunds in case of wallet closure shall be made to a local Bank account (local savings or current account). EZ-Link reserves the right to levy an admin fee on receiving your request to close the wallet.
  10. EZ-Link reserves the right to investigate complaints or reported violations of these Terms and to take any action EZ-Link deems appropriate, including, but not limited to reporting any suspected unlawful activity to law enforcement officials or regulators and disclosing any information necessary or appropriate to such persons;
  11. EZ-Link may, in its sole discretion, change, add or remove any feature or functionality of the EZ-Link Wallet at any time without any prior notice. Your continued use of the EZ-Link App shall be deemed to be your conclusive acceptance of such changes;
  12. EZ-Link reserves the right to impose, change and/or amend at any time the fees payable for your access to and use of the EZ-Link Wallet. Such changes shall be deemed effective upon posting on the website and your continued access to and use of the EZ-Link App shall be deemed to be your conclusive acceptance of such changes;
  13. For the avoidance of any doubt, you acknowledge and agree that your use of any mobile services in connection with your access to and use of the EZ-Link Wallet may entail additional charges with the respective mobile service providers and you shall be solely responsible and liable for such charges where applicable;
  14. These Terms herein shall be governed by the laws of the Republic of Singapore.

EZ-Link App

  1. TERMS OF USE 
  1. Definitions and General Terms
    1. EZ-Link App” means an app for mobile devices that can be downloaded by a user (individually a “User” and collectively, “Users”). 
    2. EZ-Link Service” means any service offered by EZ-Link which may be obtained through and from the use of the EZ-Link App, as may be determined by EZ-Link from time to time.
    3. EZ-Link Pte Ltd”, “EZ-Link”, “our”, “we” and “us” means EZ-Link Pte Ltd and its successors and assigns.
    4. You” means a User.
    5. These Terms of Use herein apply to the use of the EZ-Link App by you. By your use of the EZ-Link Services contained within the EZ-Link App, you are deemed to have read, acknowledged and agreed to these Terms contained herein and all other future revisions, which may be updated from time to time by EZ-Link Pte Ltd.
    6. You agree that you are responsible for keeping up to date with any revisions to the Terms of Use, which shall be binding on you upon the update of the EZ-Link App. If at any time, you do not agree with these Terms of Use and/or wish to discontinue your Services, please kindly cease usage of the EZ-Link App.
    7. You are also responsible for any and all activity from the EZ-Link App initiated from your user account and/or login, including any activity by authorized or unauthorized users. You shall not allow others to use your account credentials and maintain security to your user account at all times. If you should at any time become aware of any breach in the security of your user account or have any reason to believe that your credentials have been compromised, please change your password immediately and notify us of such breach.
    8. These terms of use governing the use of the EZ-Link App and the EZ-Link Service (“Terms”) incorporate any other terms and conditions which may be expressly stated in these Terms. If there is any conflict or inconsistency between these Terms and other terms and conditions, these Terms will prevail.
  2. Eligibility for the EZ-Link App
    1. You acknowledge and agree that as a condition for you to access and use the EZ-Link App to effect or obtain the EZ-Link Service, you are required to satisfy all these Terms including any amendments to these Terms that EZ-Link may in its discretion from time to time make.
  3. Registration
    1. You are required to create and register for an account in your EZ-Link App (“Registration”). 
    2. A validation of your mobile and email is also mandatory for purposes of registration. This will be done via a one-time password sent to your nominated mobile number and email address. We reserve all rights to refuse any registration made pursuant to an invalid or inaccurate mobile number or email address.
    3. You will also be required to provide such personal details as may be required from time to time and to ensure that such details are updated in a timely manner. We shall, if required and to the extent permissible by law, provide the purposes of such collection and/or disclosure.
    4. You must use your personal password (“Password”) to access and use the EZ-Link App. You are responsible for safekeeping and maintaining the confidentiality of your Password. You must not disclose to any person your Password and shall not authorize any person to use your Password for any purpose whatsoever. You agree to take reasonable measures and all due care to protect your Password against misuse by third parties.
    5. You should, as soon as possible, reset your Password should you notice that your EZ-Link App has been accessed or used without your knowledge, authority or consent.
  4. Acknowledgement and Agreement
    1. You acknowledge and agree that:
      1. you will be responsible for obtaining and using the necessary software and/or device, hardware and/or equipment necessary to obtain access to the EZ-Link App at your own risk and expense;
      2. you will be responsible to your mobile service provider for all data charges relating to: 
        (a) the download of the EZ-Link App;
        (b) any upgrades you request in relation to the EZ-Link App; and
        (c) your ongoing access to and use of the EZ-Link App;
      3. you will not use the EZ-Link App to conduct electronic spamming, upload content that contains viruses or malicious codes, perform unlawful activities, or engage in any other inappropriate activities deemed by EZ-Link;
      4. the access to and use of the EZ-Link App is offered to you on an “as available, where available” basis;
      5. you are solely responsible and liable for any access to and use of the EZ-Link App effected through the use of your Password, notwithstanding that your Password may have been used by any other person without your knowledge, authority or consent;
      6. you shall monitor the balance of your EZ-Link Card at all times and notify us (in writing, by calling our EZ-LINK hotline available at our EZ-Link website at http://www.ezlink.com.sg [“Website”]) immediately of any unauthorized transfers or of any matter concerning your EZ-Link Card that may invite suspicion;
      7. EZ-Link is entitled to send you “push notifications” and SMS notifications (“Notification”) relating to your access to and use of the EZ-Link App and any updates on related services;
      8. EZ-Link is deemed to have sent the Notification to you, even if you are unable to or do not receive the Notification for whatever reason;
      9. the EZ-Link App may include links to sites on the Internet that are owned and operated by third parties (“Third Party Sites”), and if you choose to access these Third Party Sites, you agree to review and accept the terms of use. EZ-Link has no control over and excludes all liability for and does not assume any responsibility for material created or published by such Third Party Sites;
      10. EZ-Link reserves the right to investigate complaints regarding the use of the EZ-Link App, the EZ-Link Service or reported violations of these Terms and to take any action EZ-Link deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, the appropriate authorities or regulators and disclosing any information necessary or appropriate to such officials, authorities or regulators, without any further notification to you;
      11. EZ-Link may, in its sole discretion, change, add or remove any feature or functionality of the EZ-Link App at any time without any prior notice. Your continued use of the EZ-Link App or EZ-Link Services shall be deemed to be your conclusive acceptance of such changes;
      12. EZ-Link may impose, change and/or amend at any time the fees payable for your access to and use of the EZ-Link App and the EZ-Link Service as well as the termination of the EZ-Link Service. Such changes shall be deemed effective upon EZ-Link’s posting these changes on the Website and your continued access to and use of the EZ-Link App and EZ-Link Services shall be deemed to be your conclusive acceptance of such changes; and
      13. EZ-Link may without giving any reason vary these Terms at any time. Where possible, we will strive to provide you with prior notice of our amendment of these Terms. Where we have not given prior notice, we shall as soon as practicable give notice of such amendments, deletions and additions to you by such notification method as we may choose, including through our other mobile applications, in local newspapers, in displays at any of our touchpoints or via publication through any media. Such amendments, deletions and additions shall be effective on and from the date specified in the notice.
  5. Limits of Responsibility and Liability
    1. Any Services or features provided on the EZ-Link App shall be on an “as is” basis and EZ-Link neither guarantees nor represents any express or implied warranty or condition that the EZ-Link App is available for use at all times or free from any bugs or code errors, nor does EZ-Link warrant that the EZ-Link App is compatible with all mobile platforms and/or software versions. You shall use the EZ-Link Services at your own risk and EZ-Link shall not be responsible for any claims, damages, losses or delays arising from the use of the EZ-Link App. 
    2. EZ-Link is not liable for any loss suffered by you or any third party arising from and in connection with your Registration of, access to and use of the EZ-Link App and the EZ-Link Service. Without prejudice to the foregoing, EZ-Link will not be liable for any inconvenience, loss, cost, damage or injury suffered by you or any third party arising from or caused by:
      1. our compliance with any instruction given or purported to be given by you relating to a Transaction, notwithstanding that the integrity of the information comprised in such instruction may have been compromised or impaired during transmission, provided that such compromise or impairment would not have been apparent to a reasonable person receiving such instruction;
      2. use of your EZ-Link Card and the EZ-Link App by third parties, whether authorized or unauthorized by you;
      3. theft or loss of your device, hardware and/or equipment on which the EZ-Link App is installed;
      4. your inability to effect or complete any Transaction due to system maintenance or breakdown/non-availability of the EZ-Link App or any network;
      5. you being deprived of the use of the EZ-Link App and/or the EZ-Link Service as a consequence of any action by us;
      6. any failure by us to perform any obligation or observe any of these Terms if such failure arises from a failure of, or any unauthorised and/or unlawful access to, any machine, data processing system or transmission link or any act of force majeure such as acts of God, war or warlike hostilities, civil commotions, riots, blockades, embargoes, sabotage, strikes, lock-outs, fire, flood, shortage of material or labour, delay in deliveries from sub-contractors, or any event outside our control;
      7. any equipment or software providers, any service providers, any network providers (including but not limited to telecommunications providers, internet browser providers and internet access providers), or any agent or subcontractor of any of the foregoing; or
      8. any act or omission by EZ-Link in compliance with any applicable laws and/or regulations, including laws governing personal data protection, and any instructions and/or directions given by any local or foreign regulatory body, government agency, statutory board, ministry, departments or other government bodies and/or its officials.
    3. Any downloading of data from the EZ-Link App is done solely at your risk, and we will not be liable for the integrity or use of any data downloaded in any way.
    4. EZ-Link shall not, unless otherwise expressly provided for in these Terms of Use, be responsible in any way for any direct, indirect, special or consequential, economic or other damages arising in any way from your entering into any Transaction, using the EZ-Link App or using the EZ-Link Service.
  6. Intellectual Property
    1. You acknowledge that the intellectual property rights in or to the EZ-Link App are owned by EZ-Link.
    2. No part or parts of the EZ-Link App may be reproduced, distributed, republished, displayed, broadcast, hyperlinked, transmitted, adapted, modified to create derivative works or otherwise commercially exploited in any manner or by any means or stored in an information retrieval system without our prior written permission.
    3. We shall grant you a limited and non-exclusive license to use the EZ-Link App and its services for your personal use only. 
    4. Unless otherwise stated, all logos, marks, material (inclusive of software code) and features of the EZ-Link brand are proprietary to EZ-Link Pte Ltd. You shall not copy, redistribute, reverse-engineer or commercially profit from the use of EZ-Link Pte Ltd’s intellectual property. You shall also not knowingly exploit this license for illegal, malicious purposes or in any way that is detrimental to the reputation of EZ-Link Pte Ltd. 
    5. Nothing in the EZ-Link App should be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any Trade Marks displayed in or through the EZ-Link App, without our written permission.
  7. Personal Data Protection
    1. Notwithstanding any other consent that you have already provided through the Services, you consent to EZ-Link Pte Ltd collecting, using, disclosing and storing your personal information as provided through registration, re-submission or linking of existing details on the EZ-Link App for the purposes of i) managing and creating your account on the EZ-Link App, ii) processing your balance information for display and use, iii) creation of your rewards account on the EZ-Link App, iv) contacting you to provide any customer service or after-sales support, v) providing the EZ-Link Services to you and vi) any other purposes reasonably contemplated arising out of your usage of the EZ-Link App. 
    2. The use the EZ-Link App and EZ-Link Services is contingent upon the personal data provided to EZ-Link Pte Ltd. If you wish to withdraw your consent or require EZ-Link Pte Ltd to remove your personal data, you agree and understand that it may result in your inability to continue using the EZ-Link App or EZ-Link Services.
    3. EZ-Link Pte Ltd shall collect, use, disclose and store personal data in accordance with the Personal Data Protection Act (2012) of Singapore. For more information, please refer to EZ-Link Pte Ltd’s privacy policy at: http://www.ezlink.com.sg/contact-us/personal-data-protection
    4. The EZ-Link Privacy Policy, as may be amended, supplemented and/or substituted from time to time, is incorporated by reference into and forms part of these Terms and shall apply to all personal data that you provide to us or that arises from your relationship with us.
  8. Third Parties
    1. In the course of use of the EZ-Link App, you may encounter promotions or collaborations with other third parties featured in the EZ-Link App, including but not limited to the EZ-Link App’s reward platforms. We do not make any warranties, representations or guarantees regarding the terms and conditions of any contract or agreement entered between yourself and these third parties. Unless otherwise indicated, any and all recourse to these contracts or agreements are strictly confined to the third party.
  9. Assignment
    1. EZ-Link may assign any of its obligations in the Terms of Use to any other party. You acknowledge and agree that you shall not assign any of your obligations under these Terms of Use.
  10. Termination
    1. We may (at our sole discretion) and without giving any reason suspend or terminate the EZ-Link Service or your use of the EZ-Link App at any time. Such termination shall be effective on and from the date specified in any notice provided to you.
    2. You shall not be entitled to any payment, compensation or damages from EZ-Link in relation to the termination of your access to and use of the EZ-Link App and/or the EZ-Link Service.
    3. EZ-Link’s right to suspend or terminate your access to and use of the EZ-Link App and the EZ-Link Service shall be without prejudice to any other rights or remedies which EZ-Link may have under these Terms and at law.
  11. General
    1. These Terms shall be governed by and construed in accordance with the laws of Singapore and you irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.
    2. A person who is not party to any agreement governed by these Terms shall have no right under the Contracts (Rights of Third Parties) Act to enforce any of these Terms.

 

      B. ADDITIONAL TERMS AND CONDITIONS GOVERNING THE USE OF EZ-LINK SERVICE BY EZ-LINK USER

  1. Registration
    1. During the Registration, your EZ-Link App login credentials will be used as part of the validation checks.
  2. Use of the EZ-Link App
    1. EZ-Link Card Services
      1. You may link up to 7 EZ-Link Cards (Register EZ-Link Cards) to have access to our services, including but not limited to:
        1. Checking the balance and viewing the transaction history of your EZ-Link Cards (Balance Check)
        2. Performing EZ-Link Top-up (Where possible)  (EZ-Link Top-Ups)
        3. Registration and activation for EZ-Reload (EZ-Reload)
        4. Earn and redeem EZ-Link Reward points (EZ-Link Rewards)
      2. You warrant that you are the owner of any EZ-Link Cards linked by you to the EZ-Link App, or that you have the expressed consent of the owner to do so.
      1. Balance Check
        1. All entries in the transaction history listed in your EZ-Link App (“Transaction History”) are based on best available information and EZ-Link makes no warranty as to the accuracy or availability of the transaction history.
      1. EZ-Link Top-Ups
        1. Upon registration, you may save and select at least one Credit Card as your default source of funds. Your Credit Card will be linked to your EZ-Link Card to allow the movement of funds between your Credit Card and your EZ-Link Card. You warrant that the Credit Card belongs to you.
        1. Alternative sources of funds may also be available through third party partnerships (e.g. DBS PayLah!). We do not make any warranties, representations or guarantees regarding the terms and conditions of any contract or agreement entered between yourself and these third parties. Unless otherwise indicated, any and all recourse to these contracts or agreements are strictly confined to the third party.
        1. You should not perform any EZ-Link Top-Ups during your bus ride.
      1. EZ-Reload 
        1. EZ-Reload is an auto top-up service by EZ-Link that ensures that there is always sufficient value in your EZ-Link Card, EZ-Charms and EZ-Link Wearables for your public transport and retail transactions. You can only register for EZ-Reload with locally-issued MasterCard/Visa credit cards and you can link up to seven EZ-Link Cards to each MasterCard/Visa credit account.
        2. You warrant that the credit card belongs to you and that you shall be responsible for the validity of your credit card and update us when your credit card expires.
        3. Usage of the EZ-Reload service is subject to the Terms and Conditions of the use of EZ-Reload by Card, which can be found at https://www.ezlink.com.sg/terms
      2. EZ-Link Rewards
        1. By using the EZ-Link App, you will automatically be a member of the loyalty programme named “EZ-Link Rewards” operated by the Company and/or its Affiliates (“EZ-Link Rewards).
        2. By using EZ-Link Rewards, you will gain access to the e-vouchers, promotions, discounts, free gifts, promotion codes and other benefits offered by the Company and/or third party merchants as shown on the rewards catalogue that is made available from time to time in the EZ-Link App.
        3. EZ-Link may, at its sole and absolute discretion, award you EZ-Link points (“Points) which can be used to redeem for EZ-Link Rewards.
        4. EZ-Link may, at its sole and absolute discretion, issue you points for your spend on transit and retail purposes using your EZ-Link Cards. EZ-Link Card top-ups are not eligible for earning of points. 
        5. EZ-Link may, at its sole and absolute discretion, increase or decrease the rate of Points to be awarded for each selected transaction as may be notified to you from time to time. You shall not be entitled to request from the Company any explanation pertaining to the calculation methods (for crediting the Points) or other matters relating to the Points or discounts for whatsoever purposes. 
        6. You must use your Points earned to redeem for Rewards during their applicable validity period, which is 6 months from the month that the Points were credited in your account. There shall be no extension of time for the validity period of any unused Points. The Company shall have the right to deal with the expired Points in such manner as it deems fit in its absolute discretion. You agree that you will have no claim whatsoever against the Company for any expired Points.
        7. Points have no cash or monetary value and are not redeemable for cash in any form. They cannot be purchased, resold or transferred, for value or otherwise, under any circumstances.  Points shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances, unless otherwise determined by EZ-Link. 
        8. If you comply with all these terms and conditions and have the required number of Points, you may select and redeem applicable Rewards via the Application. Your redemption of a Reward is subject to the additional terms and conditions of the Company or the third party merchant (as the case may be) that offers the particular Reward that you wish to redeem.
        9. You must use your Rewards redeemed during their applicable validity period, which may vary across different merchants. There shall be no extension of time for the validity period of any Rewards redemption dates. You agree that you will have no claim whatsoever against the Company for any expired Rewards. 
        10. You shall not hold EZ-Link responsible for any unintentional redemptions performed, nor will you contest the validity of redeemed Rewards. EZ-Link will not recognise any token used in representation of redeemed Rewards, other than the e-voucher generated in the EZ-Link App. This includes, but is not limited to photocopies, photo images, and letters of authorisation. 
        11. Rewards are not redeemable for cash nor are they exchangeable for other Rewards under any circumstances. They cannot be resold, exchanged or transferred for value under any circumstances. Rewards shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.
        12. Points that you have successfully redeemed for a Reward cannot be exchangeable for another Reward under any circumstances. No requests for exchange of Rewards will be entertained.
        13. EZ-Link may at its sole and absolute discretion reject your request to redeem Points for any reason whatsoever, including without limitation, where there are insufficient Points to redeem for the particular Reward, or where the Reward is no longer made available or out-of-stock by the third party merchant, or where the Points you wish to use for redemption of Rewards have been issued to you in error etc.
        14. You may check your Points balance and redemptions made in the EZ-Link App.  Your Points balance and redemptions as set out in the Application shall serve as a conclusive evidence of the same.
        15. To the extent as permitted by applicable laws, EZ-Link reserves the right at any time to:
          1. vary, modify or amend the terms and conditions of EZ-Link Rewards (including adding or deleting any terms);
          2. terminate or modify the EZ-Link Rewards;
          3. revoke, adjust and/or recalculate any Points awarded;
          4. change the number of Points required for redemption of specific Rewards or substitute any Reward with another of a similar value;
          5. change the number of Points that can be earned on spendings on EZ-Link Cards;
          6. modify the qualifications and eligibility for earning Points;
          7. modify the activities that earn Points;
          8. modify the methods used to calculate the number of Points to be awarded;
          9. withhold or cease the awarding of Points to you;without prior notice to you and at its sole discretion.
        1. EZ-Link may suspend the calculation and accrual of Points to rectify any errors in calculation or adjust the calculation as it reasonably deems fit without giving you prior notice or reason.
        2. You shall be responsible for any taxes, levies or duties that arise in connection with the issuance of Points to you, your redemption of Points and/or the utilization of Rewards you have redeemed and all costs and expenses relating to the same shall be borne by you.
        3. EZ-Link is not liable in any way for any claim or dispute arising between yourself and any Merchant in relation to the goods and services redeemed from the Merchant using the EZ-Link App. EZ-Link is also not responsible for any benefits, discounts or programmes of any Merchant. EZ-Link is not responsible for delivery of the goods or services provided by a Merchant and EZ-Link makes no representation as to the quality, provision of performance of any such goods or services. You acknowledge that we are not acting as agent for any Merchant.
        4. You agree that any complaints, claims, disputes or refunds in relation to goods and services provided by a Merchant shall be resolved between that Merchant and yourself, and EZ-Link shall not be responsible for any refunds made or to be made by any Merchant in respect of a Merchant Payment (whether in full or in part).
    1. EZ-Link Value-Added Services
      1. By downloading the EZ-Link App, you can:
        1. Perform EZ-Pay registration and activation (“EZ-Pay”)
        2. Use the EZ-Link Digital Wallet (“Digital Wallet”) functionality to check the balance and view the transaction history of your Digital Wallet, as well as perform top-ups to, and make payments with the QR Code payment feature at selected merchants.
      1. EZ-Pay 
        1. EZ-Pay is a post-paid card-less payment service provided by EZ-Link for motorists for their Electronic Road Pricing (ERP) and carpark (EPS) charges. You can register for EZ-Pay with supported credit or debit cards. You can register up to three vehicles for EZ-Pay by providing your car plate number to EZ-Link.
        2.  Usage of the EZ-Pay service is subject to the Terms and Conditions of the use of EZ-Pay, which can be found at https://www.ezlink.com.sg/terms
      2. Digital Wallet
        1. The Digital Wallet is a stored value facility which contains the top up stored value by you, where such stored value is capable of being used by you to perform purchases via QR Codes. You can also check the balance and view the transaction history of your Digital Wallet from the EZ-Link App.

          Restriction on use of the EZ-Link App

    1. The following limitations shall apply:
      1. each Credit Card can only be added to one EZ-Link App;
      2. a maximum top-up amount is limited to S$100 for each transaction;
      3. you will only be able to make a maximum of five top-ups using the same credit or debit card each day; 
    2. EZ-Link may, at any time and in its sole discretion, vary the limits for the above-stated limits.
  1. Use of the EZ-Link Digital Wallet
    1. You acknowledge, agree and warrant that you are, and will at all times be, in compliance with the following:
      1. You are of legal age of majority to contract in the jurisdiction in what you reside (and in any event, no less than 18 years of age) and legally capable and permitted to accede to these Terms;
      2. Refunds in case of wallet closure shall be made to a local Bank account (local savings or current account). EZ-Link reserves the right to levy an admin fee on receiving your request to close the wallet;
      3. You have a valid local mobile number registered in the EZ-Link App and it is your responsibility to keep your mobile number up to date so that EZ-Link can communicate with you electronically should the need arise during your use of the Digital Wallet due to security or privacy concerns detected by EZ-Link or any relevant party;
      4. You understand and agree that if EZ-Link sends you an electronic Communication but you do not receive it because of reasons including but not limited to message being out of date, blocked by your service provider, or you are otherwise unable to receive electronic Communications, EZ-Link will be deemed to have provided the Communication to you.
  2. Restriction on use of the EZ-Link Digital Wallet
      1. You must use your PIN number or biometric information to access and use the Digital Wallet. You are responsible for safekeeping and maintaining the confidentiality of your PIN number. You must not disclose to any person your PIN number and shall not authorize any person to use your PIN number for any purpose whatsoever. You agree to take reasonable measures and all due care to protect your PIN number against misuse by third parties;
      2. You should quickly reset your PIN number should you notice that your Digital Wallet has been accessed without your consent;
      3. You consent to receiving “push notifications” and email and/or SMS notifications from EZ-Link relating to your access to and use of the Digital Wallet.
      4. You acknowledge and agree that:
        1. the access to and use of the Digital Wallet is offered to you on an “as available, where available” basis;
        2. top up to your Digital Wallet can be done through MasterCard or Visa credit/debit cards. EZ-Link shall deduct the money from your designated source of funds and load it to the Digital Wallet;
        3. you are solely responsible and liable for any access to use of the EZ-Link App effected through the use of your Password, notwithstanding that your Password may have been used by any other person without your knowledge or authority;
        4. EZ-Link is not held responsible and liable for any wrongly configured purchases, whether of purchase value or recipient;
        5. you will ensure your mobile number is kept up to date on the EZ-Link App;
        6. you will access the Digital Wallet Management Portal with your EZ-Link App log-in details should you decide to terminate this application and trigger refund of the remaining balance from the Digital Wallet to a designated local Bank Account which you will input via the Digital Wallet Management Portal
      5. Various limits have been implemented to safeguard the potential losses and you are aware that;
        1. Maximum amount the Digital Wallet can contain at any one time is $500;
        2. Any configured top-up amount that will cause the Digital Wallet balance to exceed the maximum stored amount in the Digital Wallet will automatically block the top-up and trigger an error message;
      6. EZ-Link reserves the right to investigate complaints or reported violations of these Terms and to take any action EZ-Link deems appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials or regulators and disclosing any information necessary or appropriate to such persons without any further notification to you;
      7. EZ-Link may, in its sole discretion, change, add or remove any feature or functionality of the Digital Wallet at any time without any prior notice. Your continued use of the EZ-Link App shall be deemed to be your conclusive acceptance of such changes;
      8. EZ-Link reserves the right to impose, change and/or amend at any time the fees payable for your access to and use of the Digital Wallet. Such changes shall be deemed effective upon posting on the website and your continued access to and use of the EZ-Link App shall be deemed to be your conclusive acceptance of such changes;
      9. For the avoidance of any doubt, you acknowledge and agree that the use by you of any mobile services in connection with your access to and use of the Digital Wallet may entail additional charges with the respective mobile service providers and you shall be solely responsible and liable for such charges where applicable
  3. Others
    1. These Terms also incorporate our terms and conditions governing accounts (“Account Terms”) and all of our products as stated in our Terms & Conditions website http://www.ezlink.com.sg/terms.

FEVO

Terms and Conditions

  1. The FEVO MasterCard Electronic card (“Card”) is issued by EZ-Link Pte Ltd (“EZ-Link”), who is licensed by MasterCard to issue MasterCard cards. EZ-Link has entered into an agreement with MasterCard where Cards bearing the MasterCard logo shall be accepted for payment at all merchants or retail points where MasterCard transactions can be made.
  2. You agree to be bound by these terms & conditions (“Terms”) whenever you purchase or use the Card. In addition –
    • “You” means the person who purchased the Card, or the person for whose benefit or uses the Card has been purchased. “Your” has a corresponding meaning; and
    • “EZ-Link” means EZ-Link Pte Ltd and our successors, assignees and authorised agents. “We”, “our” and “us” have corresponding meanings.
  3. You shall:
    1. pay a card fee (“Card Fee”) of such amount (as may be determined by us from time to time) upon the initial purchase of the Card. Different Card Fees may be chargeable depending on the type of card purchased;
    2. provide identification particulars or such other information where required by EZ-Link upon the purchase of the Card.
  4. For the purposes of these Terms, Card(s) shall also refer to FEVO Prepaid MasterCard on card and non-card form factors.
  5. You shall sign the Card on the signature panel on the back of the Card immediately upon receipt, and safeguard the Card.
  6. We shall not be responsible/liable to you for any discrepancy between the signature appearing on the Card and the corresponding sales slip or if for any reason(s) the Card is not accepted. You agree and understand that any discrepancy between the signature appearing on the Card and the corresponding sales slip shall not by itself be a ground for disputing the validity of the sales transaction.
  7. Your Card shall be valid for the period (“Validity Period”) stated on the card and shall expire on the first day of the following month indicated on the face of the Card. You agree and understand that the Validity Period may not be extended.
  8. The initial stored value on the Card at any time shall not exceed Singapore Dollars One Hundred (S$100.00) unless otherwise specifically permitted by EZL. We may permit the maximum stored value on the Card to be reloaded up to Singapore Dollars One Thousand (S$1000.00) where the Card has been designated by us as a reloadable card, and you have completed such registration requirements as may be determined by us. We shall be under no obligation to accept the registration, and may in our discretion reject any registration application without providing any reasons.
  9. All card sales are limited to Singapore and delivery to Singapore addresses only. Delivery to postal boxes shall not be accepted.
  10. Top-ups, where permitted, may be done at authorised agents appointed by us. A fee may be chargeable for each top-up.
  11. You must:
    1. ensure that you have sufficient balance in your Card for the payment transaction before use;
    2. keep a secure record of your Card number and the date on which your Card expires;
    3. keep your Card safe and within your possession. No refunds or replacement shall be entertained for any lost or stolen card;
    4. sign and activate your card as soon as you receive it;
    5. always remember to take your Card back after using it; and
    6. provide us with all necessary assistance to recover any unauthorised amount paid from your available balance.
  12. You must not:
    1. allow any other person to use your Card;
    2. give your Card number and details to any unauthorised person; or
    3. leave your Card in an unattended wallet, purse or vehicle or anywhere where another person could remove your Card without being noticed.
  13. You do not have the right to stop payment on any purchase or payment transaction originated by use of your Card.
  14. If your Card has expired, you must not continue to use it. If there is any unused stored value on your Card when your Card expires, you shall no longer be entitled to use that unused stored value.
  15. You may not request for refund of the available stored value on the Card before the expiry date stated on your Card. We shall only be obliged to refund you the remaining stored value, if any, on the Card under the following conditions:
    1. a refund application form is duly completed and submitted to us;
    2. the refund application form is filed with us after the expiry date of the Card, but within 1 month from the expiry date of the Card; and
    3. a refund processing fee shall apply for each refund, and shall be deducted from the remaining stored value on the Card. We will only be obliged to process a refund if the remaining stored value exceeds the refund processing fee. If there is insufficient stored value to cover the refund processing fee, we will notify you in writing of the unsuccessful refund.
  16. The remaining stored value will be refunded or made available to you within 30 days from the date we receive your refund application form. If you do not collect or effect your refund within 50 days from the date the refund is made available, you shall be deemed to have abandoned your claim to the remaining stored value and shall no longer be entitled to the remaining stored value, and we shall have the right to deal with the unclaimed stored value as we deem fit.
  17. If you do not file for a refund within 1 month from the expiry date of your Card, you shall be deemed to have abandoned your claim to the remaining stored value and no longer be entitled to claim the remaining stored value, and we shall have the right to deal with the remaining stored value in such manner as we deem fit.
  18. Where no payment or financial transactions are made on your Card for a continuous period exceeding 3 months starting from the date of last transaction. A dormancy fee shall be charged and deducted from the remaining stored value on your Card after 3 months of inactivity on the Card, and thereafter for every month for which the Card remains inactive.
  19. You are not permitted to terminate your Card account for any reason whatsoever, and you shall not be permitted to any refund in event of any purported termination of your Card account.
  20. If your Card is damaged or defaced, you may apply for a replacement Card from us. A replacement fee determined by us shall be chargeable for the replacement of your damaged Card. You shall be entitled to a free replacement if the damage is due to malfunction of the Card within six (6) months from the date of purchase. Any remaining stored value in the damaged or defaced card shall only be transferred to the new card. Transfer of remaining stored value is only applicable to registered cards. For replacement of cards, cardholders will need to produce the damaged or defaced card and may be required to provide receipts for proof of purchase.
  21. The replacement Card shall be delivered to the Registered Cardholder’s address in Singapore.
  22. Fees will be charged for some services. Please refer to the charge table at www.fevocard.com.
  23. When you use the Card outside of Singapore, the Card transaction shall be charged in the currency of the relevant country where the Card is used, and converted into Singapore Dollars at such exchange rate at such time as may be determined by MasterCard. The conversion rate applied is based on the posting date of the Card transaction to your Card account. We shall charge you the converted amount and an administrative fee. Please refer to the charge table at www.fevocard.com.
  24. We may permit you to register the Card with us in order to be a Registered Cardholder. You shall produce the Card as well as appropriate photo identification documents (such as NRIC, Singapore driving licence and/or passport) to verify your personal particulars. Registration may also be performed through the FEVO website at www.fevocard.com, mobile app, SMS, electronic or other means permitted by us. Upon successful registration, the card may be reloadable up to the maximum stored value of Singapore Dollars One Thousand (S$1000.00). Registration also allows you to inform us to blocking and unblocking of cards and replacement in case of damage or lost. We reserve the right to add more features or withdraw any features.
  25. Registered Cardholders shall, subject to the terms and conditions herein, not be liable to us for any fraudulent transactions not authorised by you after you have reported the loss to us.
  26. We may, at any time amend any part of these Terms. We will give notice of any amendment by posting the same at our website at www.fevocard.com or through such channels as we may determine in our discretion. Any such amendment shall bind you upon notice or on the date which such amendment takes effect as specified in the notice, whichever is earlier. You shall agree that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. Your continued use of the Card after the date of such notification shall constitute an affirmative acknowledgement by you of the amendments and shall be deemed to be your acceptance of such revised Terms.
  27. Our liability for any loss or damage that you may incur arising from the use of the Card shall not exceed Singapore Dollars One Thousand (S$1000.00) or the actual loss or damage, whichever is the lower.
  28. No failure or delay on our part in exercising any power, right, or remedy under these Terms shall operate as a waiver of such power, right, or remedy.
  29. A person or entity who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act, chapter 53B of Singapore to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms.
  30. The construction, validity and performance of these Terms shall be governed by and construed in accordance with Singapore law. Each party mentioned herein hereby submits to the non-exclusive jurisdiction of the Singapore courts.

EZ-Reload by Card Facility (With effect from 1 June 2019)

DEFINITIONS AND INTERPRETATION

  1. In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:

    “Account” means any account which has been authorised by the Account Holder to enable EZ-Link to make deductions in respect of the provision of the EZ-Reload by Card Facility.

    “Account Holder” in relation to any Account means the person to whom the Account belongs to.

    “Application Form” means the form for the application of the EZ-Reload by Card Facility and includes any such form issued and/or submitted via electronic means for purposes of application for the EZ-Reload by Card Facility.

    “Card” means any credit, debit or charge card branded by VISA or MasterCard (or any other card association as may be stipulated by EZ-Link from time to time), and issued by any bank, financial institution or corporation, which may be used by the Account Holder as a means of payment for goods and/or services.

    “Card Holder” means the person bearing and using the EZ-Reload by Card Enabled ez-link card.

    “Convenience Fee” means a fee of $0.25 (or such other amount as may be determined by EZ-Link from time to time) charged to the Account Holder’s Account for each Revaluation service performed by EZ-Link.

    “Card Issuer” means the bank or financial institution issuing the Card.

    “EZ-Link” means EZ-Link Pte Ltd a company incorporated in Singapore providing the EZ-Reload by Card Facility.

    “ez-link card” means the “ez-link” branded stored-value facility owned by EZ-Link and used by the Card Holder for the payment of goods and services.

    “EZ-Reload by Card Enabled ez-link card” means an ez-link card that has been enabled with the EZ-Reload by Card Facility.

    “EZ-Reload by Card Facility” means the auto top-up service on ez-link cards provided by EZ-Link where ez-link cards are revaluated for a pre-selected amount automatically when the Stored Value on the ez-link card is equal or below the Threshold Value, and paid for by the Account Holder through the debiting of payments from the Account, and “EZ-Reload by Card” means any top-up transaction carried out on an ez-link card using the EZ-Reload by Card Facility.

    “Revalue” or “Revaluation” means adding the Revaluation Amount to the ez-link card through the use of a Revaluation Device.

    “Revaluation Amount” means the amount specified by the Account Holder to be charged to his Account for the purposes of revaluating EZ-Reload by Card Enabled ez-link cards issued to Card Holders.

    “Revaluation Device” means a bus ez-link card processor, a MRT/LRT Fare Gate or any other designated device for the Revaluation of the EZ-Reload by Card Enabled ez-link cards.

    “Stored Value” means the initial monetary value paid for and stored in an ez-link card or the residual value remaining therein from time to time.

    “Threshold Value” means that the Stored Value of the EZ-Reload by Card Enabled ez-link card has reached zero value or negative.

    “Ticket Office” means the ticket sales office located in MRT Stations and Bus Interchanges operated by TransitLink and/or other agents appointed by EZ-Link for the purpose of providing sales, revaluation, replacement, and refund services for ez-link cards, including EZ-Reload by Card Enabled ez-link cards.

    “TransitLink” means Transit Link Pte Ltd, a company incorporated in Singapore and appointed by EZ-Link to provide services in relation to the EZ-Reload by Card Facility.

  2. Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.

  3. The Terms and Conditions for EZ-Reload by Card Facility is in addition to and shall be read in conjunction with the Conditions of Issue and Use For ez-link (CEPAS) Cards issued by EZ-Link. The Conditions of Issue and Use For ez-link (CEPAS) cards are available for inspection at the Ticket Offices.

CONDITIONS OF ISSUE

  1. The Account Holder shall submit to EZ-Link a duly completed Application Form using electronic means or such other means approved by EZ-Link from time to time to apply for the EZ-Reload by Card Facility. Upon approval by EZ-Link, the ez-link card(s) nominated by the Account Holder will be enabled with the EZ-Reload by Card Facility. The Account Holder may nominate up to a maximum of seven (7) ez-link cards to be enabled with the EZ-Reload by Card Facility. EZ-Link shall not be obliged to approve any Application Form and shall not be obliged to furnish any reasons for any rejected Application Form.

  2. In consideration of provision of the EZ-Reload by Card Facility by EZ-Link, the Account Holder hereby agrees:

    1. that the Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the EZ-Reload by Card Enabled ez-link card;

    2. that the Account Holder shall ensure that EZ-Reload by Card Enabled ez-link card(s) shall only be used by persons authorised by the Account Holder;

    3. that EZ-Link shall be entitled to obtain and hold a pre-authorisation (“Pre-authorisation”) equivalent to the Revaluation Amount and Convenience Fee from the Card Issuer and will be held by EZ-Link for a period of 7 calendar days to be applied towards any pending Revaluation when the Stored Value of the EZ-Reload by Card Enabled ez-link card reaches a value of S$20.00 or less. The Account Holder acknowledges that the Pre-authorisation will not be available for use from the Account until either the Pre-authorisation is applied towards the Revaluation or where EZ-Link releases the Pre-authorisation back to the Card Issuer if no Revaluation occurs within the 7 calendar days. The Account Holder acknowledges that notwithstanding that EZ-Link has released the Pre-authorisation, the amount will only be available for the Account Holder’s use after the Card Issuer has effected the release of the amount into the Account;

    4. that EZ-Link shall be entitled to inform the Card Issuer of the successful Revaluation and that the Card Issuer shall be entitled to charge the Account pursuant to the use of the EZ-Reload by Card Facility;

    5. that EZ-Link shall be entitled to inform the Card Issuer to credit the Account with any monies that may be due from EZ-Link to the Account Holder in respect of refund of monies by EZ-Link to the Account Holder pursuant to these Terms and Conditions or otherwise;

    6. that EZ-Link shall be entitled to deduct a Convenience Fee from the Account for each Revaluation;

    7. that EZ-Link shall be entitled to deduct from the Account any monies owing to EZ-Link in respect of any Revaluations done on ez-link cards nominated by the Account Holder; and

    8. that EZ-Link shall be entitled to blacklist or otherwise invalidate any EZ-Reload by Card Enabled ez-link card where the Account Holder is in breach of these Terms and Conditions. This shall include but not limited to EZ-Link blacklisting and terminating the ez-link card.

  3. Notwithstanding anything to the contrary herein contained, the Account Holder agrees that a minimum period of 24 hours must elapse between each Revaluation for each EZ-Reload by Card Enabled ez-link card. EZ-Link shall not be obliged to revalue the EZ-Reload by Card Enabled ez-link card with another Revaluation Amount until after the Account has been successfully debited for any previous Revaluation Amounts.

CONDITIONS OF USE

  1. The Account Holder hereby undertakes as follows:
    1. to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use For ez-link (CEPAS) Cards are adhered to by the Card Holder where applicable;

    2. to ensure that the Account is valid and there are sufficient funds or sufficient credit limit in the Account at all times in order to meet deductions by EZ-Link pursuant to the EZ-Reload by Card Facility and in accordance with this Terms and Conditions;

    3. to inform EZ-Link immediately of any closure or termination of the Account or change in the Account that may prevent EZ-Link from deducting from the Account the applicable Revaluation Amount and Convenience Fee for each Revaluation;

    4. to provide EZ-Link with any information as may be reasonably requested by EZ-Link in relation to the issue, use and cancellation of the EZ-Reload by Card Enabled ez-link card, and the termination of the EZ-Reload by Card Facility, and to render any and all necessary assistance to EZ-Link and/or any agents appointed by EZ-Link in relation to any investigation relating to the use of the EZ-Reload by Card Enabled ez-link card;

    5. to instruct EZ-Link to terminate the EZ-Reload by Card Facility prior to the closure or termination of the Account; and

    6. save where the EZ-Reload by Card Enabled ez-link card has been reported lost and cancelled in accordance with paragraph 6.2, to be responsible for all transactions, including any Revaluation, made by the use or purported use of the EZ-Reload by Card Enabled ez-link card

PAYMENT

  1. In the event that EZ-Link fails to receive payment for the EZ-Reload by Card Facility in respect of any Revaluation for any reason whatsoever, EZ-Link shall have the right to do any or all of the following:

    1. Recover from the Account Holder the outstanding Revaluation Amounts and/or Convenience Fee plus all costs incurred (including legal costs on a full indemnity basis) for the recovery of payment from the Account Holder to EZ-Link. In addition, EZ-Link shall be entitled to recover any outstanding amounts due from the Account Holder via deduction from the remaining value contained in any other EZ-Reload by Card Enabled ez-link card (“Associated Card”) registered under the Account Holder.

    2. For the purpose referred to in paragraph 4.1.1, EZ-Link shall have the right to suspend the use of and/or terminate the use of the EZ-Reload by Card Enabled ez-link cards or any Associated Card.

    3. Terminate the EZ-Reload by Card Facility pursuant to paragraph 7.3.2;

    4. Disqualify the Account Holder from applying for, being considered for and/or successfully accepted under the EZ-Reload by Card Facility for any new ez-link cards for such length of time as may be determined to be appropriate by EZ-Link; and

    5. Deduct or set-off any monies owing to EZ-Link from the remaining value in respect of any EZ-Reload by Card Enabled ez-link cards issued or held in respect of that Account or the Account Holder.

    6. EZ-Link shall contact the Account Holder to arrange to refund of any excess money (free of interest) remaining in the EZ-Reload by Card Enabled ez-link cards after recovery of all monies owing to EZ-Link.

    7. EZ-Link shall not be obligated to bear the cost of any replacement ez-link card where the EZ-Reload by Card Enabled ez-link cards has been terminated under this Terms and Conditions.

LIMIT OF LIABILITY

  1. The provisions relating to exclusion of liability in the Conditions of Issue and Use For ez-link (CEPAS) Cards shall apply in full to the use of any EZ-Reload by Card Enabled ez-link cards.

LOSS OF EZ-LINK CARD

  1. It is the responsibility of the Account Holder to report the loss of any EZ-Reload by Card Enabled ez-link card (“Lost ez-link Card”) to EZ-Link at its hotline at telephone number 6496 8300 during the hours of 8.00 am to 6.00 p.m. with one or more of the following information:

    1. Name of the Account Holder.
    2. NRIC or passport number of the Account Holder.
    3. Engraved identification number of the affected EZ-Reload by Card Enabled ez-link card(s).

    In the event that the Lost ez-link Card is discovered outside of the hotline operating hours, the Account Holder may leave a voice mail reporting the loss with the above details. EZ-Link will attend to the loss report the next working day.

  2. EZ-Link shall cancel the Lost ez-link Card within 48 hours after a Lost ez-link Card has been reported in accordance with paragraph 6.1. EZ-Link shall refund to the Account Holder the remaining Stored Value on the Lost ez-link Card (if any) within 4 weeks of the date of cancellation. EZ-Link shall not be liable to refund to the Account Holder for any monies deducted from the Lost ez-link Card within the period of 48 hours after the Lost ez-link Card has been reported lost, whether such deductions from the Lost ez-link Card were made with the Account Holder’s or Card Holder’s knowledge or consent or not.

  3. Until the expiry of 48 hours after a Lost ez-link Card has been reported, the Account Holder shall be liable for any Revaluation to the Lost ez-link Card via the EZ-Reload by Card Facility as well as any deductions incurred on the ez-link card, and EZ-Link shall be entitled to deduct from the Account for the Revaluation performed. Where the Account Holder does not make a lost report to EZ-Link, the Account Holder shall continue to be liable for any deductions incurred or Revaluation occurring on the Lost ez-link Card.

  4. The Account Holder shall not be liable for any Revaluation or deductions made on the Lost ez-link Card after the the expiry of 48 hours from the time of reporting loss of the ez-link Card.

  5. Where the loss of an EZ-Reload by Card Enabled ez-link card has been reported, the Account Holder or Card Holder will have to re-apply for the EZ-Reload by Card Facility for the replacement ez-link card.

TERMINATION OF EZ-RELOAD BY CARD FACILITY

  1. The Account Holder may terminate the EZ-Reload by Card Facility by presenting the relevant EZ-Reload by Card Enabled ez-link card(s) at TransitLink (EZ-Link’s appointed agent) or any Ticket Offices. The Account Holder shall pay all outstanding monies payable to EZ-Link prior to termination of the EZ-Reload by Card Facility. However, termination of the Facility is not allowed while an outstanding debit Amount is pending. Upon payment of the outstanding Amount, the Facility may then be terminated.

  2. The EZ-Reload by Card Facility may be terminated by EZ-Link upon giving at least 7 days’ written notice of the intention to terminate to the Account Holder.

  3. Notwithstanding paragraph 7.2, EZ-Link reserves the right to terminate the EZ-Reload by Card Facility upon written notice to the Account Holder and the Bank in the event that:

    1. there is a breach by the Account Holder or Card Holder in respect of any of the Terms and Conditions contained herein;

    2. there is a failure to receive payment of monies owing to it as provided in paragraph 4;

    3. the Account of the Account Holder is no longer valid; or

    4. EZ-Link is unable to successfully deduct the Revaluation Amount and/or Convenience Fee from the Account.

  4. Upon termination of the EZ-Reload by Card Facility howsoever, the EZ-Reload by Card Facility shall be disabled on the ez-link card, and:

    1. Any and all monies due and owing to EZ-Link by the Account Holder in relation to the terminated EZ-Reload by Card Enabled ez-link card shall be paid within 2 weeks of the date of notification by EZ-Link (as the case may be) of the amount due and owing; and

    2. Provided that EZ-Link shall have the right to set-off any monies owing to it from such remaining Stored Value.

  5. Where the Account Holder owes any amount to EZ-Link in respect of the EZ-Reload by Card Facility services provided by EZ-Link, EZ-Link may in its discretion reject any further application to register any ez-link card for EZ-Reload by Card Facility until any amounts owing has been paid in full.

REFUND FOR SURRENDERED EZ-RELOAD BY CARD ENABLED EZ-LINK CARDS

  1. Account Holders who wish to surrender any EZ-Reload by Card Enabled ez-link card can do so at TransitLink, any Ticket Office or any other locations or channels designated by EZ-Link from time to time.

  2. Any remaining value on the EZ-Reload by Card Enabled ez-link card, based on the amount as determined from EZ-Link’s computer records, will be refunded free of interest to the Account Holder and shall be credited to his Account within 4 weeks of the date of surrender.

AMENDMENT

EZ-Link may from time to time amend any part of these Terms and Conditions as EZ-Link thinks fit. EZ-Link may give notice of any amendment by posting the amended Terms and Conditions at EZ-Link’s website (www.ezlink.com.sg) or at any Ticket Office at MRT and LRT stations and bus interchanges, and/or such other premises as may be determined by EZ-Link or by sending the Account Holder a notice, or by any method which EZ-Link thinks fit. The Card Holder agrees that any notification of amendments as aforesaid shall be sufficient notice for the purpose of this paragraph. The continued use of the EZ-Reload by Card Enabled ez-link card after the date of such notification shall constitute an affirmative acknowledgement by the Account Holder of the amendments and shall be deemed to be the Account Holder’s acceptance of such revised Terms and Conditions.

NOTICES

Unless otherwise provided herein all notices, demands or other communications by EZ-Link shall be in writing to the address of the Account Holder as stated in EZ-Link’s records and shall be deemed served if

  1. delivered by hand, on the day of delivery;
  2. by ordinary post, on the day following that on which the notice was posted; or
  3. by facsimile transmission, on the day the facsimile was transmitted.

NO WAIVER

No failure or delay on the part of EZ-Link or its agents in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy, nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.

RIGHT OF THIRD PARTIES

A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.

LAW

The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore. The Account Holder hereby submits to the exclusive jurisdiction of the Singapore courts.

EZ-Reload by GIRO Facility (With effect from 1 June 2019)

DEFINITIONS AND INTERPRETATION

  1. In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:

    “Account” means the bank account designated by the Account Holder in the Application for the EZ-Reload by GIRO Facility and accepted by EZ-Link and the Bank for debiting of Revaluations via EZ-Reload by GIRO.

    “Account Holder” means the person who has had an ez-link card enabled with the EZ-Reload by GIRO Facility by EZ-Link and whose Account will be debited in respect to automatic or customer activated Revaluations made to the EZ-Reload by GIRO Enabled ez-link card(s) held or issued to Cardholder(s) at his request.

    “Application” means the application of the EZ-Reload by GIRO Facility and includes any such application via electronic means or otherwise for purposes of application for the EZ-Reload by GIRO Facility.

    “Application Fee” means the $1.00 fee (or such other amount as determined by EZ-Link from time to time) payable by the Account Holder to EZ-Link for each application submitted for the EZ-Reload by GIRO Facility.

    “Bank” means any bank licensed to operate retail-banking services in Singapore and participating in the EZ-Reload by GIRO Facility.

    “ez-link card” means the multi-purpose stored-value contactless smartcard issued by EZ-Link for the payment of goods and services.

    “Card Holder” in respect to a EZ-Reload by GIRO Enabled ez-link card refers to the Account Holder or a person nominated by the Account Holder in the Application for the EZ-Reload by GIRO Facility who is authorised to collect and use an EZ-Reload by GIRO Enabled ez-link card, linked to the Account, or the Holder of a EZ-Reload by GIRO Enabled ez-link card.

    “Deduction” means the deduction of the Amount from the Account by the Bank and payable to EZ-Link upon each Revaluation.

    “Deposit” means an amount equivalent to the Revaluation Amount which shall be deducted upon the successful application of the EZ-Reload by GIRO Facility for each EZ-Reload by GIRO Enabled ez-link card, and which shall be held by EZ-Link, and in the event the Deduction by the Bank of the Revaluation Amount from the Account is unsuccessful, such Deposit may be applied by EZ-Link towards settlement of the Revaluation Amount which has been topped-up onto the ez-link card.

    “EZ-Link” refers to EZ-Link Pte Ltd, the issuer of the ez-link card and the provider of the EZ-Reload by GIRO Facility.

    “ez-link card” means the multi-purpose contactless stored value facility issued by EZ-Link for the payment of goods and services.

    EZ-Link Pte Ltd

    “EZ-Reload by GIRO Facility” or “Facility” means the auto top-up service of a nominated ez-link card whereby the ez-link card nominated by the Account Holder can be topped up for a pre-selected amount (and deducted from the Account) automatically by a public transport fare system 2

    device or such other devices authorised by EZ-Link when the remaining value in the ez-link card is equal or below a threshold value.

    “EZ-Reload by GIRO Enabled ez-link card” means an ez-link card that has been nominated and enabled for EZ-Reload by GIRO.

    “Public transport fare system device” means a bus contactless smartcard Processor, a MRT Fare Gate or a LRT Fare Gate.

    “Revaluation” means adding stored value to the ez-link card via the EZ-Reload by GIRO Facility.

    “Revaluation Amount” means the amount specified by the Account Holder in the Application to be deducted from his Account for the purposes of topping up the EZ-Reload by GIRO Enabled ez-link card issued to Card Holders, or the amount as may be subsequently changed by the Account Holder.

    “Ticket Office” means an office located in MRT Stations and Bus Interchanges operated by TransitLink or an authorised agent of EZ-Link for the purpose of providing sales, top-ups, replacement, and refund services for ez-link cards, including EZ-Reload by GIRO Enabled ez-link cards.

    “TransitLink” means Transit Link Pte Ltd, a company incorporated in Singapore and appointed by EZ-Link to provide services relating to the ez-link card.

  2. Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.

  3. The Terms and Conditions for the Use of EZ-Reload by GIRO Facility are in addition to the Conditions of Issue and Use Of EZ-Link (CEPAS) Cards issued by EZ-Link. In the event of any inconsistency between the Terms and Conditions contained herein and the Conditions of Issue and Use Of EZ-Link (CEPAS) Cards, the Terms and Conditions herein shall prevail.

    CONDITIONS OF USE

    1. Any Account Holder may upon approval by the Bank and EZ-Link have his nominated ez-link card(s) enabled with the EZ-Reload by GIRO Facility.

    2. In consideration of the enabling of the nominated ez-link card(s) with the EZ-Reload by GIRO Facility by EZ-Link, the Account Holder hereby agrees:

      1. that EZ-Link is authorized to deduct from the Account the applicable Deposit for each EZ-Reload by GIRO Enabled ez-link card;

      2. that the Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the EZ-Reload by GIRO Facility and the EZ-Reload by GIRO Enabled ez-link card;

      3. that EZ-Link and the Bank shall be entitled to establish the proper linkage between the Account and the said EZ-Reload by GIRO Enabled ez-link card;

      4. that EZ-Link shall be entitled to authorise the Bank and that the Bank shall be entitled to debit the Account pursuant to the use of the EZ-Reload by GIRO Facility;

      5. to pay the Application Fee to EZ-Link for each ez-link card enabled with the EZ-Reload by GIRO Facility.

      6.  that EZ-Link shall be entitled to authorise the Bank and that the Bank shall be entitled to credit the Account with any monies that may be due from EZ-Link to the Account Holder in respect of refund of monies by EZ-Link to the Account Holder pursuant to the Terms and Conditions or otherwise.

    3. Notwithstanding anything to the contrary herein contained, the Account Holder agrees that a minimum period, to be determined by EZ-Link, must elapse between each Revaluation of the EZ-Reload by GIRO Enabled ez-link card. EZ-Link shall not be obliged to Revalue the EZ-Reload by GIRO Enabled ez-link card with another Revaluation Amount until after the Account has been successfully debited for any previous Revaluation Amounts.

    UNDERTAKING BY ACCOUNT HOLDER

    1. The Account Holder hereby undertakes as follows:

      1. to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use of EZ-Link (CEPAS) Cards are adhered to by the Card Holder where applicable;

      2. to maintain at all times a sufficient balance in his Account to enable the Bank to make the requisite debits in respect of the use of the EZ-Reload by GIRO Facility;
      3. to provide EZ-Link with any information as may be reasonably requested by EZ-Link in relation to the use and cancellation of the EZ-Reload by GIRO Facility, and the termination of the EZ-Reload by GIRO Facility, and to render any and all necessary assistance to EZ-Link in relation to any investigation relating to the use of the EZ-Reload by GIRO Facility; and

      4. subject to paragraph 6.2, to be responsible for all transactions made by the use or purported use of the EZ-Reload by GIRO Enabled ez-link cards by any person whether with or without the knowledge or consent of the Account Holder.

    PAYMENT

    1. In the event that EZ-Link fails to receive payment in respect of any monies to be debited from the Account for any reason whatsoever, EZ-Link shall have the right to do any or all of the following:

      1. Deduct from the Deposit to settle the Revaluation Amount effected onto the EZ-Reload by GIRO Enabled ez-link card and owing to EZ-Link, and in addition to authorize EZ-Link to further deduct an amount equivalent to the Revaluation Amount in order to maintain the Deposit for the purposes of the EZ-Reload by GIRO Facility..

      2. Impose on the Account Holder an administrative charge (“Administrative Fee”) of $2.00 for each unsuccessful Deduction from the Account.

      3. Suspend the use of all EZ-Reload by GIRO Enabled ez-link cards issued in respect of that Account and to reactivate the use of the said card(s) only upon the Account Holder’s settlement of all monies owed to EZ-Link, including the Top-Up Amount and Administrative Fee.

      4. Terminate the use of any or all EZ-Reload by GIRO Enabled ez-link cards issued in respect of that Account and/or terminate the EZ-Reload by GIRO Facility pursuant to paragraph 7.3.2 and

      5. Disqualify the Account Holder and/or the Card Holder(s) from applying for, being considered for and/or successfully accepted under the EZ-Reload by GIRO Facility for any new ez-link cards for such length of time as may be determined to be appropriate by EZ-Link.

      6. Deduct or set-off any monies owing to EZ-Link from the remaining value paid in respect of any EZ-Reload by GIRO Enabled ez-link cards issued or held in respect of that Account or the Account Holder.

    LIMIT OF LIABILITY

    The provisions relating to exclusion of liability in the Conditions of Issue and Use Of Ez-link cards shall apply in full to the use of any EZ-Reload by GIRO Enabled ez-link cards.

    LOSS OF EZ-RELOAD BY GIRO ENABLED EZ-LINK CARDS

    1. It is the responsibility of the Account Holder or Card Holder(s) to report the loss of any EZ-Reload by GIRO Enabled ez-link cards to EZ-Link via the EZ-Link mobile app or the EZ-Link customer service hotline with one or more of the following information:

      1. Name of the Account Holder.
      2. NRIC or passport number of the Account Holder.
      3. Engraved identification number of the affected EZ-Reload by GIRO Enabled ez-link card(s).
    2. EZ-Link shall cancel the lost EZ-Reload by GIRO Enabled ez-link Card within 48 hours after a loss report has been reported in accordance with paragraph 6.1. EZ-Link shall refund to the Account Holder the remaining Stored Value on the lost ez-link card (if any) and the Deposit (less any deductions) within 4 weeks of the date of cancellation. EZ-Link shall not be liable to refund to the Account Holder for any monies deducted from the Lost ez-link Card within the period of 48 hours after the lost ez-link card has been reported lost, whether such deductions from the lost ez-link card were made with the Account Holder’s or Card Holder’s knowledge or consent or not.

    3. The Account Holder shall not be liable for any Revaluation or deductions made on the Lost ez-link Card after the Lost ez-link Card has been cancelled.

    4. Where the loss of an EZ-Reload by GIRO Enabled ez-link cards has been reported, the Account Holder or Card Holder will have to re-apply for the EZ-Reload by GIRO Facility for the replacement ez-link card.

    TERMINATION OF EZ-RELOAD BY GIRO FACILITY

    1. The Account Holder may terminate the EZ-Reload by GIRO Facility by presenting the relevant EZ-Reload by GIRO Enabled ez-link card(s) at TransitLink (EZ-Link’s appointed agent) or any Ticket Offices. The Account Holder shall pay all outstanding monies payable to EZ-Link prior to termination of the EZ-Reload by GIRO Facility. However, termination of the facility is not allowed while an outstanding debit Amount is pending. Upon payment of the outstanding Amount, the facility may then be terminated.

    2. EZ-Link reserves the right to terminate the EZ-Reload by GIRO Facility in the event that:

      1. there is a breach by the Account Holder or Card Holder in respect of any of the Terms and Conditions contained herein; or

      2. there is a failure to receive payment of monies owing to it as provided in paragraph 4.

      3. the Account of the Account Holder is no longer valid; or

      4. EZ-Link is unable to successfully deduct the Revaluation Amount from the Account.

    3. Upon termination of the EZ-Reload by GIRO Facility by EZ-Link, the EZ-Reload by GIRO Facility shall be disabled on the ez-link card, and:

      1. All monies due and owing to EZ-Link by the Account Holder in relation to the terminated EZ-Reload by GIRO Enabled ez-link cards shall be paid within 2 weeks of the date of notification by EZ-Link/TransitLink of the amount due and owing; and

      2. The remaining value paid on the EZ-Reload by GIRO Enabled ez-link cards shall remain on the ez-link card;

      3. Provided that EZ-Link shall have the right to set-off any monies owing to it from such remaining Stored Value on the ez-link card.

    REFUND FOR SURRENDERED EZ-RELOAD BY GIRO ENABLED EZ-LINK CARDS

    1. Card Holders of EZ-Reload by GIRO Enabled ez-link cards who wish to surrender their ez-link cards, can do so at any Ticket Office or any other locations or channels designated by EZ-Link from time to time.
    2. The value remaining, if any, of the EZ-Reload by GIRO Enabled ez-link cards, based on the amount as determined from EZ-Link’s computer records including the Deposit (less any deductions), will be refunded free of interest to the Account Holder and shall be credited to his Account within 4 weeks of the date of surrender.

    AMENDMENT

    EZ-Link may from time to time amend any part of these Terms and Conditions. EZ-Link will give notice of any amendment by posting the amended Terms and Conditions at on the EZ-Link website at www.ezlink.com.sg. The Card Holder agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If the Card Holder does not accept any amendments, he shall cease all use of the ez-link card. The Card Holder’s continued use of the ez-link card after the date of such notification shall constitute an affirmative acknowledgement by the Card Holder of the amendments and shall be deemed to be the Card Holder’s acceptance of such revised Terms and Conditions.

    NOTICES

    1. Unless otherwise provided herein all notices, demands or other communications by EZ-Link shall be in writing to the address of the Account Holder as stated in EZ-Link’s records and shall be deemed served if

      1. delivered by hand, on the day of delivery;
      2. by ordinary post, on the day following that on which the notice was posted; or
      3. by SMS, mobile app push notification or email, on the day of delivery or
      4. by facsimile transmission, on the day the facsimile was transmitted.

    NO WAIVER

    No failure or delay on the part of EZ-Link, its agents, or any service provider in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy. Nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.

    RIGHT OF THIRD PARTIES

    A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.

    LAW

    EZ-Reload e-statement

    1. The EZ-Reload e-Statement Service (“Service”) is a value-add default service provided by EZ-Link for users of EZ-Reload by GIRO and EZ-Reload by Card who have registered their email address with EZ-Link. Please read and understand the Terms and Conditions for the Service as the use of the Service will constitute your agreement to and acknowledgement of these terms and conditions as well as the acknowledgement of all the inherent risks in the transmission of e-Statement via e-mail.
    2. The provision of this Service is at EZ-Link’s discretion, and such Service may be modified, suspended, withdrawn, cancelled or discontinued by EZ-Link at any time.
    3. You will receive the e-Statement only if you have activated the EZ-Reload accounts and have made top-up transaction through EZ-Reload by GIRO or EZ-Reload by Card.
    4. Each bank or credit/debit card account will receive only one e-Statement per month.
    5. You agree to release us from any liability whatsoever resulting from any unauthorised assess from any party to your e-Statement sent to your designated email address (“Designated Email”). You agree that EZ-Link cannot warrant the timeliness, security, confidentiality or availability in the transmission of the e-Statements to the Designated Email.
    6. You may terminate the Service at any time by submitting a request via phone call to our call centre. On such request, EZ-Link shall remove your email address from our records as soon as possible. Do note that in such a time where your email address is again provided to EZ-Link for the purpose of facilitating the application, enquiry, termination or any other investigation purposes, your email address will be reinstated into our records.
    7. You are required to check all e-Statements for any unauthorized transactions, and if you are aware of any unauthorized transaction(s) on any of the e-Statements, you must notify both EZ-Link and your bank as soon as reasonably practicable.
    8. EZ-Link may from time to time advertise its products and services as well as those of its partners through the e-Statement Service.
    9. You understand that EZ-Link will use its best endeavours to ensure the security of the Service. Notwithstanding the foregoing, you agree that EZ-Link shall not liable in any manner for any disruption, unavailability of the Service, communication, electrical or network failure that may result in the e-Statements being incomplete, unavailable or delayed in transmission. You also understand that the while EZ-Link will take all reasonable measures, we cannot guarantee that the use of and the transmission of information via email is secure, and that the information transmitted may be liable to errors, viruses, delay, interception, modification or amendment by unauthorized persons, the transmission may be disrupted, interrupted, delayed or incorrect. You agree that in subscribing to the Service, you will not hold EZ-Link responsible for any errors, viruses, delay, inaccuracy, losses, damages whatsoever arising from or in connection with the customer use of the Service including but not limited to any interception, modification or amendment, disruption, interruption, delay or inaccuracy of e- mails or internet transmission or other communication equipment or facilities. For the avoidance of doubt, EZ-Link shall not be responsible for any losses suffered whether direct, indirect, consequential, or special loss, even if EZ-Link shall have been advised of the same.
    10. You agree that you will not hold EZ-Link responsible for any consequences that may arise as a result of any online communication between you and EZ-Link which may be lost in transmission (whether in whole or in part).
    11. You acknowledge and agree that EZ-Link shall have the right to amend any term(s) of this agreement at any time by giving such notice in writing to the customer, whether by mail, facsimile, e-mail notification or otherwise or by notices at EZ-Link’s website, and your continued subscription to the Service will constitute your agreement to the amendment(s).

    Auto Top Up for Concession Cards

    TERMS AND CONDITIONS FOR THE USE OF AUTO TOP-UP ENABLED CONCESSION CARDS

    1. DEFINITIONS AND INTERPRETATION

    1.1 In these terms and conditions (“Terms and Conditions”),the following words and expressions shall have the meaning ascribed to them:

    “Account” means the Bank or Credit card account designated by the Account Holder in the Application Form for the Auto top-up Facility and accepted by the Bank for debiting of top-ups.

    “Account Holder” means the person who has had a Concession card enabled at his request with the Auto top-up Facility by EZ-Link and whose Account will be debited upon automatic or customer activated top-ups made to the Auto top-up enabled Concession card(s).

    “Application Form” means the form issued by EZ-Link for the application of the Auto top-up Facility and includes any such form issued via electronic means for purposes of application for the Auto top-up Facility, or touch screen application menus of GTMs operated at MRT and LRT stations, and bus interchanges.

    “Auto top-up enabled Concession card” and any replacement of the same means a Concession card that can be topped up for a pre-selected amount automatically by a public transport fare system device when the remaining value is below a threshold value, or through an action of the Concession card Holder at selected terminal devices and GTMs.

    “Bank” means any bank licensed to operate retail-banking services in Singapore and participating in the GIRO inter-bank system of cashless payments and the Auto top-up Facility scheme, and includes any financial institution that issues Credit card that are used for the purposes of the Auto Top-up Facility.

    “Charges” means the charges incurred by the Concession card Holder(s) in respect of services provided or goods purchased from service providers who have contracted with EZ-Link to accept the Concession card as a mode of payment.  Such charges may include any and all applicable goods and services tax, imposition, duty and levy whatsoever which are or may from time to time be imposed or charged by any government, statutory body or tax authority.

    “Concession card” means the multi-purpose stored-value contactless smartcard issued for the payment of goods and services including concessionary travel on public transport.

    “Concession card Holder” in respect to a Auto top-up enabled Concession card refers to the Account Holder or a person nominated by the Account Holder in the Application Form for the Auto top-up Facility who is authorised to collect and use an Auto top-up enabled Concession card, linked to the Account, or the Holder of a Concession card that has been Auto top-up enabled and linked to the Account through an online application process.

    “Credit card” means any credit or debit card branded by VISA or MasterCard or any other source of funds approved by EZ-Link .

    “EZ-Link” means EZ-Link Pte Ltd a company incorporated in Singapore providing the Auto top-up Facility

    “Facility” means the facility for topping up the Auto top-up enabled Concession card by an amount correspondingly debited or to be debited from the Account.

    “GIRO” means the system of electronic fund transfer in which funds are transferred from a bank account of a depositor to an organisation or organisations designated by the depositor.

    “GTM” means the General Ticketing Machine (or any other similar machines) deployed at MRT and LRT stations and bus interchanges for topping up of Concession cards, applying for the Auto top-up (GIRO) Facility, and/or other functions on Auto top-up enabled Concession cards.

    “Public transport fare system device” means a bus contactless smartcard Processor, MRT Fare Gate or a LRT Fare Gate.

    “Top-up” means adding value to the Concession card either by a contactless smartcard device, a load agent contactless smartcard device, a public transport fare system device, a merchant operated terminal device or a GTM.

    “Top-Up Amount” means the amount specified by the Account Holder in the Application Form to be deducted from his bank account or Credit card for the purposes of topping up the Auto top-up enabled Concession cards issued to Concession card Holders, or the amount subsequently changed by the Account Holder through an electronic online process.

    “Ticket Office” means an office located in MRT Stations and Bus Interchanges operated by TransitLink for the purpose of providing sales, top-ups, replacement, and refund services for Concession cards, including Auto top- up enabled Concession cards.

    “TransitLink” means Transit Link Pte Ltd, a company incorporated in Singapore and having its registered office at 9 Maxwell Road #03-02 Annexe A MND Complex Singapore 069112.

    1.2 Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.

    1.3 The Terms and Conditions for the Use of Auto Top-up Enabled Concession Cards are in addition to the Conditions of Issue and Use of Concession Cards. The Conditions of Issue and Use of Concession Cards are available at TransitLink’s website at www.transitlink.com.sg. In the event of any inconsistency between the Terms and Conditions contained herein and the Conditions of Issue and Use of Concession Cards, the Terms and Conditions herein shall prevail.

    2. CONDITIONS OF ENABLING AND USE OF AUTO TOP UP FACILITY

    2.1 Any Concession card Holder may upon approval by the Bank and EZ-Link have his Concession card enabled with the Auto Top-up Facility.

    2.2 In consideration of the enabling of an existing Concession card with the Auto Top-up Facility by EZ-Link , the Account Holder hereby agrees:

    — 2.2.1 that these Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the Auto top-up enabled Concession card;

    — 2.2.2. that the said Concession card shall be issued or enabled in the name of the Concession card Holder who shall be entitled to the use thereof;

    — 2.2.3 that EZ-Link shall be entitled to obtain and hold a pre-authorisation (“Pre-authorisation”) equivalent to the Top-Up Amount from the Bank and will be held by EZ-Link for a period of 7 calendar days to be applied towards any pending Top-Up when the Stored Value of the Auto top-up enabled Concession card goes below the threshold amount determined by EZ-Link. The Account Holder acknowledges that the Pre- authorisation will not be available for use from the Account until either the Pre-authorisation is applied towards the Top-Up or where EZ-Link releases the Pre-authorisation back to the Bank if no Top-Up occurs within the 7 calendar days. The Account Holder acknowledges that notwithstanding EZ-Link has released the Pre-authorisation, the amount will only be available for the Account Holder’s use after the Bank has effected the release of the amount into the Account;

    — 2.2.4 that EZ-Link and the Bank shall be entitled to establish the proper linkage between the Account and the said Auto top-up enabled Concession card;

    — 2.2.5 that EZ-Link shall be entitled to authorise the Bank and that the Bank shall be entitled to debit the Account pursuant to the use of the Auto top-up Facility;

    — 2.2.6 that EZ-Link shall be entitled to authorise the Bank and that the Bank shall be entitled to credit the Account with any monies that may be due from EZ-Link to the Account Holder in respect of refund of monies by EZ-Link to the Account Holder pursuant to the Terms and Conditions or otherwise;

    — 2.2.7 that EZ-Link shall be entitled to obtain an authorisation for any pending Auto Top-up upon the approval of the application for Auto Top-up by credit card and upon an Auto Top-up on the Auto Top-up enabled Concession card; and

    — 2.2.8 that EZ-Link shall be entitled to blacklist or otherwise invalidate any or all Auto Top-up enabled Concession card linked by the Account Holder where the Account Holder is in breach of these Terms and Conditions.

    2.3 Notwithstanding anything to the contrary herein contained, the Account Holder agrees that a minimum period of 4 calendar days or such other period to be determined by EZ-Link must elapse between each top-up of the Auto Top-up enabled Concession card. EZ-Link shall not be obliged to top-up the Auto Top-up enabled Concession card with another Top-Up Amount until after the Account has been successfully debited for any previous Top- Up Amounts.

    2.4 The Account Holder hereby undertakes as follows:

    — 2.4.1 to ensure that the Concession card Holder of the Auto Top-up enabled Concession card will not allow the Concession card to be used by any person ineligible for the use of the said Concession card;

    — 2.4.2 to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use of Concession cards are adhered to by the Concession card Holder where applicable;

    — 2.4.3 to maintain at all times a sufficient balance or credit limit in his Account to enable the Bank to make the requisite debits in respect of the use of the Auto Top-up enabled Concession card;

    — 2.4.4 to provide any information as may be reasonably requested by EZ-Link/TransitLink in relation to the use and cancellation of the Auto Top-up enabled Concession card, and the application and termination of the Auto Top-up Facility, and to render any and all necessary assistance to EZ-Link/TransitLink in relation to any investigation relating to the use of the Auto Top-up enabled Concession card;

    — 2.4.5 subject to paragraph 5.2, to be responsible for all transactions made by the use or purported use of the Auto top-up enabled Concession card by any person whether with or without the knowledge or consent of the Account Holder;

    — 2.4.6 to instruct EZ-Link/TransitLink to terminate the Auto top-up Facility prior to the closure or termination of the Account; and

    — 2.4.7 save where the Auto Top-up enabled Concession card has been reported lost and the Auto Top-up Facility has been cancelled in accordance with paragraph 5.2, to be responsible for all transactions, including any Top-Ups, made by the use or purported use of the Auto Top-up enabled Concession card by any person whether with or without the knowledge or consent of the Account Holder.

    3. PAYMENT

    3.1 In the event that EZ-Link fails to receive payment in respect of any monies to be debited from the Account for any reason whatsoever, EZ-Link shall have the right to do any or all of the following:

    — 3.1.1 Suspend the use of all Auto Top-up enabled Concession cards linked to that Account.

    — 3.1.2 Terminate the use of any or all Auto top-up enabled Concession cards linked to that Account or Account Holder and/or terminate the Auto Top-up Facility pursuant to paragraph 6.3.2

    — 3.1.3 Disqualify the Account Holder and/or the Auto top-up enabled Concession card Holder(s) from applying for, being considered for and/or successfully accepted under the Auto top-up Facility for any new Concession cards for such length of time as may be determined to be appropriate by EZ-Link .

    — 3.1.4 Deduct or set-off any monies owing to EZ-Link from the remaining value paid in respect of any Auto top-up enabled Concession cards linked to that Account or the Account Holder, and/or

    — 3.1.5 Recover from the Account Holder the amount payable and all costs incurred (including legal cost on a full indemnity basis for the recovery of such payment.

    4. LIMIT OF LIABILITY

    The provisions relating to exclusion of liability in the Conditions of Issue and Use Of Concession Cards shall apply in full to the use of any Auto top-up enabled Concession cards.

    5. LOSS OF AUTO TOP-UP ENABLED CONCESSION CARD

    5.1 It is the responsibility of the Account Holder or Concession card Holder to report the loss of any Auto top-up enabled Concession card to TransitLink via its Hotline at 1800-225 5663 (operating from 8.00 am – 6.00 pm daily, except public holidays) or such other approved channels. In the event that the lost Auto top-up enabled Concession card is lost outside the hotline operating hours, the Account Holder or Concession card Holder may still call the Hotline to provide their contact details for TransitLink to return their call on the next working day to complete the filing of the lost report.

    5.2 Once the loss of an Auto top-up enabled Concession card has been reported to TransitLink, TransitLink shall cancel the lost card within forty eight (48) hours from the time of the report. The Account Holder shall only be responsible for subsequent unauthorised usage (if any) of the Auto top-up enabled Concession card within the period of 48 hours after Lost Auto top up enabled Concession card has been reported lost:

    — 5.2.1 for payment of fares on public transport services provided by the public transport operators, save that TransitLink shall refund the cardholder for any deductions for fares for public transport services exceeding $10.00 in aggregate within the 48 hours after the Lost Auto Top-up enabled Concession Card has been reported lost, and

    — 5.2.2 for all payment of goods and services other than for public transport services within the 48 hours after the Lost Auto top-up enabled Concession Card has been reported lost, whether such deductions from the Lost Auto Top-up enabled Concession Card were made with the Account Holder’s knowledge or consent or not.

    5.3 The remaining value on the lost Auto Top-up enabled Concession card less any unauthorised usage, in accordance to 5.2, subject to EZ-Link’s right to deduct or set off any amount owing to EZ-Link in respect of any other Concession card linked to the Account, be refunded to the Account Holder’s Account within two (2) weeks of the date of cancellation.

    5.4 Where the loss of an Auto Top-up enabled Concession card has been reported, the Account Holder or Concession Card Holder will have to re-apply for the Auto Top-up Facility for the replacement Concession card.

    6. TERMINATION OF AUTO TOP-UP FACILITY

    6.1 Concession card Holders may terminate the Auto Top-up Facility at Ticket Offices by presenting their Concession card or via such other means or channels as may be determined by EZ-Link. However, termination of the Facility is not allowed while an outstanding debit amount is pending. Upon payment of the outstanding amount, the Facility may then be terminated.

    6.2 EZ-Link reserves the right to terminate the Auto Top-up Facility in the event that:

    — 6.2.1 there is a breach by the Account Holder or Auto Top-up enabled Concession card Holder in respect of any of the Terms and Conditions contained herein; or

    — 6.2.2 there is a failure to receive payment of monies owing to it as provided in paragraph 3.

    6.3 Upon termination of the Auto Top-up Facility by EZ-Link, the Auto Top-up Facility shall be disabled on the Concession card, and:

    — 6.3.1 All monies due and owing to EZ-Link by the Account Holder in relation to the terminated Auto Top-up enabled Concession card shall be paid within two (2) weeks from the date of notification by EZ-Link of the amount due and owing;

    — 6.3.2 The remaining value paid on the Auto Top-up enabled Concession card shall remain on the Concession card; and

    — 6.3.3 Provided that EZ-Link shall have the right to set-off any monies owing to it from such remaining value on the Auto Top-up enabled Concession card.

    6.4 In the event payment is not made by the date specified in paragraph 6.3.1, EZ-Link reserves the right to impose an administrative charge or such amount of interest on the amount unpaid as is reasonable in the circumstances.

    7. REFUND FOR SURRENDERED AUTO TOP-UP ENABLED CONCESSION CARDS

    7.1 Holders of Auto Top-up enabled Concession cards who wish to surrender their Concession cards, can do so at any Ticket Office or via any other locations or channels designated by EZ-Link from time to time.

    7.2 The value remaining (“remaining value”), if any, of the Auto top-up enabled Concession card, based on the amount as determined from EZ-Link’s computer records, will be refunded free of interest to the Account Holder and shall be credited to his Account within two (2) weeks of the date of surrender of the Auto top-up enabled Concession card. The refund is subject to an administrative fee as determined from time to time by EZ-Link and to EZ-Link’s right to deduct or set off any amount owing to EZ-Link in respect of any other Concession card linked to the Account. No refund will be made for any personalisation fee or card cost.

    8. AMENDMENT

    EZ-Link may from time to time amend any part of these Terms and Conditions. EZ-Link will give notice of any amendment by posting the amended Terms and Conditions on EZ-Link’s website at www.ezlink.com.sg, and/or such other premises or channels as may be determined by EZ-Link. The Concession card Holder agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If the Concession card Holder does not accept any amendments, he shall cease all use of the Concession card. The Concession card Holder’s continued use of the Concession card after the date of such notification shall constitute an affirmative acknowledgement by the Concession card Holder of the amendments and shall be deemed to be the Concession card Holder’s acceptance of such revised Terms and Conditions.

    9. NOTICES
    Unless otherwise provided herein all notices, demands or other communications by EZ-Link shall be in writing to the Account Holder as stated in EZ-Link’s records and shall be deemed served if

    9.1 delivered by hand, on the day of delivery;

    9.2 by ordinary post, on the day following that on which the notice was posted;

    9.3 by email to the Concession card Holder’s last known email address; or

    9.4 by SMS to the Concession card Holder’s last known mobile number.

    10. NO WAIVER

    No failure or delay on the part of EZ-Link, TransitLink, their agents, or any service provider in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy. Nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.

    11. RIGHT OF THIRD PARTIES

    A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.

    12. FORCE MAJEURE

    Neither EZ-Link, TransitLink nor any of their respective agents shall be liable for non- performance, error, interruption or delay in the performance of their obligations under this Terms and Conditions, in the card system’s operation if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:-

    (i) flood, lightning, acts of God, fire, earthquakes and other natural disaster;
    (ii) judgments, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; and
    (iii) power failure.

    13. LAW

    The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore.
    The Account Holder hereby submits to the non-exclusive jurisdiction of the courts of Singapore.

    EZ-Pay

    DEFINITIONS AND INTERPRETATIONS

    1. In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:“Account” means your credit card account in which you have authorised us to enable us to make deductions in respect of the provision of EZ-Pay services.“Account Holder”, “You” or “Your” in relation to any Account means the person to whom the Account belongs to and who is using the EZ-Pay services.“Application” means an online or hardcopy application required to be submitted to EZ-Link including via EZ-Pay website for purposes of application for EZ-Pay.“Card” means any credit card branded by VISA or MasterCard issued by a Card Issuer, which may be used by the Account Holder as a means of payment for Electronic Road Pricing (ERP) and Electronic Parking Services (EPS) only.“Card Holder” means the person using EZ-Pay.“Card Issuer” means the bank or financial institution which has partnered with EZ-Link to allow Cards issued by it to be accepted for EZ-Pay services.“EZ-Link”, “We”, “Us” or “Our” means EZ-Link Pte Ltd a company incorporated in Singapore providing the EZ-Reload by Card Facility.“EZ-Pay” or “EZ-Pay Service” means the post-paid card-less payment solution for payment for Electronic Road Pricing (ERP) and Electronic Parking Services (EPS), and paid for by the Account Holder through the debiting of payments from the Account.“EZ-Pay Account” means an account which has been set-up for you online when you register for the EZ-Pay services in order to view your transactions.
    2. Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.

      REGISTRATION

      1. Before you can use EZ-Pay Service, you must register your vehicle and Card details with EZ-Link in order to open an EZ-Pay account.
      2. To use EZ-Pay:
        1. You must be the owner of a privately-owned Singapore registered vehicle which you are registering for EZ-Pay;
        2. You must have a Visa or MasterCard credit card issued by Card Issuer and valid for use. This is the registered card for the EZ-Pay service;
        3. You can register up to three vehicles for one Card in order to obtain an EZ-Pay account.
        4. You may register any vehicle that is not owned by you to your EZ-Pay account, but you will be liable for all EZ-Pay charges charged to your Card.
      3. You must register with us by filling in an online application at our website or hardcopy application to register for the EZ-Pay service. You must provide us with accurate, complete and updated information when registering your personal particulars with us.
      4. It will take about five (5) working days to process your application. We will send you an SMS and email notification in an estimated of 4 working days to advise on the application status, your EZ-Pay account and the effective start date of the EZ-Pay service.
      5. You agree and understand that the EZ-Pay shall only be useable for payment on Electronic Road Pricing (ERP) charges collected by Land Transport Authority and Electronic Parking Services (EPS) services at selected car parks which accept payment via EPS solutions.
      6. In consideration of providing this EZ-Pay service, you hereby agree:
        1. that this Terms and Conditions shall bind on you in respect of all matters relating to the use of the EZ-Pay services;
        2. that we shall be entitled to obtain and hold a pre-authorisation (“Pre-authorisation”) from your available credit limit under your Card and this amount will be held by us for a recurring period of 5 calendar days to be applied towards your Account when it reaches a value of S$50.00 or less. You may see the Pre-authorisation amount reflected in your Card statement. You acknowledge that the Pre-authorisation amount will not be available for your use under the Account until either the Pre-authorisation amount is applied in full or where EZ-Link releases the Pre-authorisation (for any reason including upon unsuccessful Pre-authorisation). You acknowledge that the Pre-authorisation can be held for a period of 5 calendar days (or such other period we require) and the Pre-authorisation can be refreshed by us so long as you are registered for the EZ-Pay Service. You acknowledge that notwithstanding that EZ-Link has released the Pre-authorisation, the amount will only be available for your use after the Card Issuer has effected the release of the amount into the Account, which shall be on a best efforts basis after 7 days;
        3. In the event that EZ-Link is unable to obtain a Pre-authorisation, EZ-Link shall have the right to terminate the EZ-Pay service without notice;
        4. that EZ-Link shall be entitled to inform the Card Issuer of the Pre-authorisation and that the use of EZ-Pay shall be charged to the Card; and that EZ-Link shall be entitled to inform the Card Issuer to charge your Account with any monies that may be due from you to EZ-Link for the use of EZ-Pay pursuant to these Terms and Conditions or otherwise;
        5. that EZ-Link shall be entitled to inform the Card Issuer to credit the Account with any monies that may be due from EZ-Link to you in respect of refund of monies by EZ-Link to you pursuant to these Terms and Conditions or otherwise; and
        6. that EZ-Link shall be entitled to terminate the Account where the Account Holder is in breach of these Terms and Conditions. This shall include but not limited to EZ-Link terminating the Account.

      CONDITIONS OF USE OF EZ-PAY

      1. You hereby undertake as follows:
        1. to ensure that the Terms and Conditions contained herein are adhered to by you at all times;
        2. to ensure that the Account is valid at all times and there are sufficient funds or sufficient credit limit in the Account at all times in order to meet deductions by EZ-Link pursuant to the EZ-Pay and in accordance with these Terms and Conditions;
        3. to inform EZ-Link immediately of any closure or termination of the Account or change in the Account that may prevent EZ-Link from obtaining a Pre-authorisation or effecting charges from the Account;
        4. to provide EZ-Link with any information as may be reasonably requested by EZ-Link in relation to the issue, use and termination of the EZ-Pay, and to render any and all necessary assistance to EZ-Link and/or any agents appointed by EZ-Link in relation to any investigation relating to the use of the EZ-Pay;
        5. to immediately instruct EZ-Link to terminate the EZ-Pay prior to the closure or termination of the Account or in the event the Card is lost or stolen; and
        6. to be responsible for all Pre-authorisations and charges made to the EZ-Pay account notwithstanding the loss or theft of the Card or the theft or transfer of the vehicle to which the EZ-Pay account is registered to until such time when you inform us to close or terminate the EZ-Pay Account.

      PAYMENT

      1. In the event that we fail to receive payment for the EZ-Pay or for any reason whatsoever, we have the right to do any or all of the following:
        1. Recover for the payment from you to be paid to EZ-Link in respect of the EZ-Pay services (including legal costs on a full indemnity basis). In addition, we are entitled to recover any outstanding amounts due from you by charging the Card including but not limited to deducting the payment from the Pre-authorisation amount.
        2. For the purpose referred to paragraph (a), EZ-Link shall have the right to suspend the use of and/or terminate the use of the EZ-Pay.
        3. Terminate the EZ-Pay without notice pursuant to paragraph 5.
        4. Disqualify you from applying for, being considered for and/or successfully accepted under the EZ-Pay for such length of time as may be determined to be appropriate by us.
        5. In terminating the EZ-Pay service, we shall not be liable to you for any fines or penalties arising from non-payment of ERP or EPS charges arising from the EZ-Pay service being terminated.

      TERMINATION OF EZ-PAY

      1. You may terminate EZ-Pay through our website. You shall pay all outstanding monies payable to EZ-Link prior to termination of EZ-Pay.
      2. You will be required to terminate and re-apply EZ-Pay should there be a change in the number of the registered Card.
      3. You will be required to terminate EZ-Pay if the registered vehicle has been sold or if the registered vehicle or the applicable IU is lost or stolen, failing which you will be liable for all charges incurred by that vehicle. You shall remain liable for any EZ-Pay payments arising from your failure or delay in terminating the EZ-Pay. You may re-apply for the EZ-Pay services for the new vehicle.
      4. EZ-Pay may be terminated by EZ-Link upon giving written notice of the intention to terminate the Account Holder. Up to four (4) working days are required to process the termination.
      5. Notwithstanding paragraph 5.4, EZ-Link reserves the right to immediately terminate EZ-Pay upon written notice to the Account Holder and the Card Issuer in the event that:
        1. there is a breach by the Account Holder in respect of any of the Terms and Conditions contained herein;
        2. there is a failure to receive payment of monies owing to it as provided in paragraph 4;
        3. the Account of the Account Holder is no longer valid; or
        4. EZ-Link is unable at any time to successfully obtain pre-authorisation from the Account.
      6. Where you owe any amount to EZ-Link in respect of EZ-Pay services provided by EZ-Link, EZ-Link may in its discretion reject any further application to register EZ-Pay until all amounts owing has been paid in full.

      AMENDMENT

      1. EZ-Link may from time to time amend any part of these Terms and Conditions as EZ-Link thinks fit. EZ-Link will send you a notice for the amendments by SMS or email, or by any method which EZ-Link thinks fit. You agree that any notification of amendments as aforesaid shall be sufficient notice for the purpose of this paragraph. The continued use of EZ-Pay after the date of such notification shall constitute an affirmative acknowledgement by you of the amendments and shall be deemed to be your acceptance of such revised Terms and Conditions.

      NOTICES

      1. Unless otherwise provided herein all notices, demands or other communications by EZ-Link shall be in writing to the address of the Account Holder as stated in EZ-Link’s records and shall be deemed served if delivered:
        1. by SMS to the mobile number registered with EZ-Link
        2. by hand, on the day of delivery;
        3. by ordinary post, on the day following that on which the notice was posted; or
        4. by email, on the day the email was transmitted.

      NO WAIVER

      1. No failure or delay on the part of EZ-Link or its agents in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy, nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.

      INDEMNITY

      1. You shall indemnify and keep fully indemnified EZ-Link at all times against all liabilities, costs (including legal costs on an indemnity basis), expenses, damages and losses including any direct losses and all interest, penalties and other reasonable costs and expenses suffered or incurred by you arising from any breach arising out of or relating to the use of EZ-Pay, as well as any actions or your omissions.

      LIMITATION OF LIABILITIES

      1. You agree that EZL shall not be liable to you for any loss or damage howsoever caused and regardless of the form of loss or damage which may be suffered or incurred by EZL in connection with this Terms and Conditions including (without prejudice to the generality of the foregoing) any loss of profit, revenue, anticipated savings, indirect or inconsequential damages of any kind whatsoever caused by you.

      RIGHT OF THIRD PARTIES

      1. A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.

      PERSONAL DATA

      1. In the course of providing the EZ-Pay services, you understand and agree that EZ-Link may collect, compile, store, process and use Personal Data belonging to you for the purposes of processing, providing and managing the EZ-Pay services. You also agree that EZ-Link has the right to disclose Personal Data collected from you to Land Transport Authority and EZ-Link’s subcontractors for the purpose of operating and providing the EZ-Pay services.
      2. EZ-Link represents and warrants that it shall comply with the requirements of the Personal Data Protection Act (Act 26 of 2012 of Singapore) (“PDPA”) in respect of the collection, use, disclosure and other handling of Personal Data, and that such data will not be transferred out of Singapore for any reason.“Personal Data” means data, whether true or not, about an individual which can be identified
        • from the data; or
        • from that data and other information to which the receiving party has or is likely to have access.

      LAW

      1. The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore. You hereby submit to the exclusive jurisdiction of the Singapore courts.
