Auto Top-Up for Concession Cards

TERMS AND CONDITIONS FOR THE USE OF AUTO TOP-UP ENABLED CONCESSION CARDS
  1. DEFINITIONS AND INTERPRETATION
    1. In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them:“Account” means the Bank or Credit card account designated by the Account Holder in the Application Form for the Auto top-up Facility and accepted by the Bank for debiting of top-ups.“Account Holder” means the person who has had a Concession card enabled at his request with the Auto top-up Facility by EZ-Link and whose Account will be debited upon automatic or customer activated top-ups made to the Auto top-up enabled Concession card(s).“Application Form” means the form issued by EZ-Link for the application of the Auto top-up Facility and includes any such form issued via electronic means for purposes of application for the Auto top-up Facility, or touch screen application menus of GTMs operated at MRT and LRT stations, and bus interchanges.“Auto top-up enabled Concession card” and any replacement of the same means a Concession card that can be topped up for a pre-selected amount automatically by a public transport fare system device when the remaining value is below a threshold value, or through an action of the Concession card Holder at selected terminal devices and GTMs.“Bank” means any bank licensed to operate retail-banking services in Singapore and participating in the GIRO inter-bank system of cashless payments and the Auto top-up Facility scheme, and includes any financial institution that issues Credit card that are used for the purposes of the Auto Top-up Facility.“Charges” means the charges incurred by the Concession card Holder(s) in respect of services provided or goods purchased from service providers who have contracted with EZ-Link  to accept the Concession card as a mode of payment.  Such charges may include any and all applicable goods and services tax, imposition, duty and levy whatsoever which are or may from time to time be imposed or charged by any government, statutory body or tax authority.“Concession card” means the multi-purpose stored-value contactless smartcard issued for the payment of goods and services including concessionary travel on public transport.“Concession card Holder” in respect to a Auto top-up enabled Concession card refers to the Account Holder or a person nominated by the Account Holder in the Application Form for the Auto top-up Facility who is authorised to collect and use an Auto top-up enabled Concession card, linked to the Account, or the Holder of a Concession card  that has been  Auto top-up enabled and linked to the Account through  an online application process.“Credit card” means any credit or debit card branded by VISA or MasterCard or any other source of funds approved by EZ-Link .“EZ-Link” means EZ-Link Pte Ltd a company incorporated in Singapore providing the Auto top-up Facility“Facility” means the facility for topping up the Auto top-up enabled Concession card by an amount correspondingly debited or to be debited from the Account.“GIRO” means the system of electronic fund transfer in which funds are transferred from a bank account of a depositor to an organisation or organisations designated by the depositor.“GTM” means the General Ticketing Machine (or any other similar machines) deployed at MRT and LRT stations and bus interchanges for topping up of Concession cards, applying for the Auto top-up (GIRO) Facility, and/or other functions on Auto top-up enabled Concession cards.“Public transport fare system device” means a bus contactless smartcard Processor, MRT Fare Gate or a LRT Fare Gate.“Top-up” means adding value to the Concession card either by a  contactless smartcard device, a load agent contactless smartcard device, a public transport fare system device, a merchant operated terminal device or a GTM.“Top-Up Amount” means the amount specified by the Account Holder in the Application Form to be deducted from his bank account or Credit card for the purposes of topping up the Auto top-up enabled Concession cards issued to Concession card Holders, or the amount subsequently changed by the Account Holder through an electronic online process.“Ticket Office” means an office located in MRT Stations and Bus Interchanges operated by TransitLink for the purpose of providing sales, top-ups, replacement, and refund services for Concession cards, including Auto top-up enabled Concession cards.“TransitLink” means Transit Link Pte Ltd, a company incorporated in Singapore and having its registered office at 9 Maxwell Road #03-02 Annexe A MND Complex Singapore 069112
    2. Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.
    3. The Terms and Conditions for the Use of Auto Top-up Enabled Concession Cards are in addition to the Conditions of Issue and Use of Concession Cards.  The Conditions of Issue and Use of Concession Cards are available at TransitLink’s website at www.transitlink.com.sg.  In the event of any inconsistency between the Terms and Conditions contained herein and the Conditions of Issue and Use of Concession Cards, the Terms and Conditions herein shall prevail.
  2. CONDITIONS OF ENABLING AND USE OF AUTO TOP UP FACILITY
    1. Any Concession card Holder may upon approval by the Bank and  EZ-Link have his Concession card enabled with the Auto top-up Facility.
    2. In consideration of the enabling of an existing Concession card with the Auto top-up Facility by EZ-Link , the Account Holder hereby agrees:
      1. that these Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the Auto top-up enabled Concession card;
      2. that the said Concession card shall be issued or enabled in the name of the Concession card Holder who shall be entitled to the use thereof;
      3. that EZ-Link shall be entitled to obtain and hold a pre-authorisation (“Pre-authorisation”) equivalent to the Top-Up Amount from the Bank and will be held by EZ-Link for a period of 7 calendar days to be applied towards any pending Top-Up when the Stored Value of the Auto top-up enabled Concession card goes below the threshold amount determined by EZ-Link.  The Account Holder acknowledges that the Pre-authorisation will not be available for use from the Account until either the Pre-authorisation is applied towards the Top-Up or where EZ-Link releases the Pre-authorisation back to the Bank if no Top-Up occurs within the 7 calendar days.  The Account Holder acknowledges that notwithstanding EZ-Link has released the Pre-authorisation, the amount will only be available for the Account Holder’s use after the Bank has effected the release of the amount into the Account;
      4. that  EZ-Link and the Bank shall be entitled to establish the proper linkage between the Account and the said Auto top-up enabled Concession card;
      5. that  EZ-Link shall be entitled to authorise the Bank and that the Bank shall be entitled to debit the Account pursuant to the use of the Auto top-up Facility;
      6. that  EZ-Link  shall be entitled to authorise the Bank and that the Bank shall be entitled to credit the Account with any monies that may be due from EZ-Link to the Account Holder in respect of refund of monies by EZ-Link  to the Account Holder pursuant to the Terms and Conditions or otherwise;
      7. that EZ-Link shall be entitled to obtain an authorisation for any pending Auto top-up upon the approval of the application for Auto top-up by credit card and upon an Auto top-up on the Auto top-up enabled Concession card; and
      8. that EZ-Link shall be entitled to blacklist or otherwise invalidate any or all Auto top-up enabled Concession card linked by the Account Holder where the Account Holder is in breach of these Terms and Conditions.
    3. Notwithstanding anything to the contrary herein contained, the Account Holder agrees that a minimum period of 4 calendar days or such other period to be determined by EZ-Link must elapse between each top-up of the Auto top-up enabled Concession card.  EZ-Link  shall not be obliged to top-up the Auto top-up enabled Concession card with another Top-Up Amount until after the Account has been successfully debited for any previous Top-Up Amounts.
    4. The Account Holder hereby undertakes as follows:
      1. to ensure that the Concession card Holder of the Auto top-up enabled Concession card will not allow the Concession card to be used by any person ineligible for the use of the said Concession card;
      2. to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use of Concession cards are adhered to by the Concession card Holder where applicable;
      3. to maintain at all times a sufficient balance or credit limit in his Account to enable the Bank to make the requisite debits in respect of the use of the Auto top-up enabled Concession card;
      4. to provide any information as may be reasonably requested by EZ-Link/TransitLink in relation to the use and cancellation of the Auto top-up enabled Concession card, and the application and termination of the Auto top-up Facility, and to render any and all necessary assistance to EZ-Link/TransitLink in relation to any investigation relating to the use of the Auto top-up enabled Concession card;
      5. subject to paragraph 5.2, to be responsible for all transactions made by the use or purported use of the Auto top-up enabled Concession card by any person whether with or without the knowledge or consent of the Account Holder;
      6. to instruct EZ-Link/TransitLink to terminate the Auto top-up Facility prior to the closure or termination of the Account; and
      7. save where the Auto top-up enabled Concession card has been reported lost and the Auto top-up Facility has been cancelled in accordance with paragraph 5.2, to be responsible for all transactions, including any Top-Ups, made by the use or purported use of the Auto top-up enabled Concession card by any person whether with or without the knowledge or consent of the Account Holder.
  3. PAYMENT
    1. In the event that EZ-Link fails to receive payment in respect of any monies to be debited from the Account for any reason whatsoever, EZ-Link shall have the right to do any or all of the following:
      1. Suspend the use of all Auto top-up enabled Concession cards linked to that Account.
      2. Terminate the use of any or all Auto top-up enabled Concession cards linked to that Account or Account Holder and/or terminate the Auto top-up Facility pursuant to paragraph 6.3.2
      3. Disqualify the Account Holder and/or the Auto top-up enabled Concession card Holder(s) from applying for, being considered for and/or successfully accepted under the Auto top-up Facility for any new Concession cards for such length of time as may be determined to be appropriate by EZ-Link .
      4. Deduct or set-off any monies owing to EZ-Link  from the remaining value paid in respect of any Auto top-up enabled Concession cards linked to that Account or the Account Holder, and/or
      5. Recover from the Account Holder the amount payable and all costs incurred (including legal cost on a full indemnity basis for the recovery of such payment.
  4. LIMIT OF LIABILITY
    The provisions relating to exclusion of liability in the Conditions of Issue and Use Of Concession Cards shall apply in full to the use of any Auto top-up enabled Concession cards.
  5. LOSS OF AUTO TOP-UP ENABLED CONCESSION CARD
    1. It is the responsibility of the Account Holder or Concession card Holder to report the loss of any Auto top-up enabled Concession card to TransitLink via its Hotline at 1800-225 5663 (operating from 8.00 am – 6.00 pm daily, except public holidays) or such other approved channels.   In the event that the lost Auto top-up enabled Concession card is lost outside the hotline operating hours, the Account Holder or Concession card Holder may still call the Hotline to provide their contact details for TransitLink to return their call on the next working day to complete the filing of the lost report.
    2. Once the loss of an Auto top-up enabled Concession card has been reported to TransitLink, TransitLink shall cancel the lost card within forty eight (48) hours from the time of the report.   The Account Holder shall only be responsible for subsequent unauthorised usage (if any) of the Auto top-up enabled Concession card within the period of 48 hours after Lost Auto top up enabled Concession card has been reported lost:
      1. for payment of fares on public transport services provided by the public transport operators, save that TransitLink shall refund the cardholder for any deductions for fares for public transport services exceeding $10.00 in aggregate within the 48 hours after the Lost Auto top-up enabled Concession Card has been reported lost, and
      2. for all payment of goods and services other than for public transport services within the 48 hours after the Lost Auto top-up enabled Concession Card has been reported lost, whether such deductions from the Lost Auto top-up enabled Concession Card were made with the Account Holder’s knowledge or consent or not.
    3. The remaining value on the lost Auto top-up enabled Concession card less any unauthorised usage, in accordance to 5.2, subject to EZ-Link’s right to deduct or set off any amount owing to EZ-Link  in respect of any other Concession card linked to the Account, be refunded to the Account Holder’s Account within two (2) weeks of the date of cancellation.
    4. Where the loss of an Auto top-up enabled Concession card has been reported, the Account Holder or Concession Card Holder will have to re-apply for the Auto top-up Facility for the replacement Concession card .
  6. TERMINATION OF AUTO TOP-UP FACILITY
    1. Concession card Holders may terminate the Auto top-up Facility at Ticket Offices by presenting their Concession card or via such other means or channels as may be determined by EZ-Link.  However, termination of the Facility is not allowed while an outstanding debit amount is pending.  Upon payment of the outstanding amount, the Facility may then be terminated.
    2. EZ-Link reserves the right to terminate the Auto top-up Facility in the event that:
      1. there is a breach by the Account Holder or Auto top-up enabled Concession card Holder in respect of any of the Terms and Conditions contained herein; or
      2. there is a failure to receive payment of monies owing to it as provided in paragraph 3.
    3. Upon termination of the Auto top-up Facility by EZ-Link , the Auto top-up Facility shall be disabled on the Concession card, and:
      1. All monies due and owing to EZ-Link  by the Account Holder in relation to the terminated Auto top-up enabled Concession card shall be paid within two (2) weeks from the date of notification by EZ-Link  of the amount due and owing;
      2. The remaining value paid on the Auto top-up enabled Concession card shall remain on the Concession card; and
      3. Provided that EZ-Link shall have the right to set-off any monies owing to it from such remaining value on the Auto top-up enabled Concession card.
    4. In the event payment is not made by the date specified in paragraph 6.3.1, EZ-Link  reserves the right to impose an administrative charge or such amount of interest on the amount unpaid as is reasonable in the circumstances.
  7. REFUND FOR SURRENDERED AUTO TOP-UP ENABLED CONCESSION CARDS
    1. Holders of Auto top-up enabled Concession cards who wish to surrender their Concession cards, can do so at any Ticket Office or via any other locations or channels designated by EZ-Link from time to time.
    2. The value remaining (“remaining value”), if any, of the Auto top-up enabled Concession card, based on the amount as determined from EZ-Link’s computer records, will be refunded free of interest to the Account Holder and shall be credited to his Account within two (2) weeks of the date of surrender of the Auto top-up enabled Concession card. The refund is subject to an administrative fee as determined from time to time by EZ-Link  and to EZ-Link’s  right to deduct or set off any amount owing to EZ-Link  in respect of any other Concession card linked to the Account.  No refund will be made for any personalisation fee or card cost.
  8. AMENDMENT
    EZ-Link  may from time to time amend any part of these Terms and Conditions.  EZ-Link will give notice of any amendment by posting the amended Terms and Conditions on EZ-Link’s website at www.ezlink.com.sg, and/or such other premises or channels as may be determined by EZ-Link. The Concession card Holder agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph.  If the Concession card Holder does not accept any amendments, he shall cease all use of the Concession card.  The Concession card Holder’s continued use of the Concession card after the date of such notification shall constitute an affirmative acknowledgement by the Concession card Holder of the amendments and shall be deemed to be the Concession card Holder’s acceptance of such revised Terms and Conditions.
  9. NOTICES
    Unless otherwise provided herein all notices, demands or other communications by EZ-Linkshall be in writing to the Account Holder as stated in EZ-Link’s records and shall be deemed served if

    1. delivered by hand, on the day of delivery;
    2. by ordinary post, on the day following that on which the notice was posted;
    3. by email to the Concession card Holder’s last known email address; or
    4. by SMS to the Concession card Holder’s last known mobile number.
  10. NO WAIVERNo failure or delay on the part of  EZ-Link, TransitLink, their agents, or any service provider in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy.  Nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.
  11. RIGHT OF THIRD PARTIESA person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description.  For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.
  12. FORCE MAJEURENeither  EZ-Link, TransitLink nor any of their respective agents shall be liable for non- performance, error, interruption or delay in the performance of their obligations under this Terms and Conditions, in the card system’s operation if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:-(i)    flood, lightning, acts of God, fire, earthquakes and other natural disaster;
    (ii)   judgments, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; and
    (iii)   power failure.
  13. LAWThe Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore.   The Account Holder hereby submits to the non-exclusive jurisdiction of the courts of Singapore.

Auto Top-Up e-statement

Auto Top-up (EZ-Reload) e-statement
  1. The EZ-Reload e-Statement Service (“Service”) is a value-add default service provided by EZ-Link for users of EZ-Reload by GIRO and EZ-Reload by Card who have registered their email address with EZ-Link. Please read and understand the Terms and Conditions for the Service as the use of the Service will constitute your agreement to and acknowledgement of these terms and conditions as well as the acknowledgement of all the inherent risks in the transmission of e-Statement via e-mail.
  2. The provision of this Service is at EZ-Link’s discretion, and such Service may be modified, suspended, withdrawn, cancelled or discontinued by EZ-Link at any time.
  3. You will receive the e-Statement only if you have activated the EZ-Reload accounts and have made top-up transaction through EZ-Reload by GIRO or EZ-Reload by Card.
  4. Each bank or credit/debit card account will receive only one e-Statement per month.
  5. You agree to release us from any liability whatsoever resulting from any unauthorised assess from any party to your e-Statement sent to your designated email address (“Designated Email”). You agree that EZ-Link cannot warrant the timeliness, security, confidentiality or availability in the transmission of the e-Statements to the Designated Email.
  6. You may terminate the Service at any time by submitting a request via phone call to our call centre. On such request, EZ-Link shall remove your email address from our records as soon as possible. Do note that in such a time where your email address is again provided to EZ-Link for the purpose of facilitating the application, enquiry, termination or any other investigation purposes, your email address will be reinstated into our records.
  7. You are required to check all e-Statements for any unauthorized transactions, and if you are aware of any unauthorized transaction(s) on any of the e-Statements, you must notify both EZ-Link and your bank as soon as reasonably practicable.
  8. EZ-Link may from time to time advertise its products and services as well as those of its partners through the e-Statement Service.
  9. You understand that EZ-Link will use its best endeavours to ensure the security of the Service. Notwithstanding the foregoing, you agree that EZ-Link shall not liable in any manner for any disruption, unavailability of the Service, communication, electrical or network failure that may result in the e-Statements being incomplete, unavailable or delayed in transmission. You also understand that the while EZ-Link will take all reasonable measures, we cannot guarantee that the use of and the transmission of information via email is secure, and that the information transmitted may be liable to errors, viruses, delay, interception, modification or amendment by unauthorized persons, the transmission may be disrupted, interrupted, delayed or incorrect. You agree that in subscribing to the Service, you will not hold EZ-Link responsible for any errors, viruses, delay, inaccuracy, losses, damages whatsoever arising from or in connection with the customer use of the Service including but not limited to any interception, modification or amendment, disruption, interruption, delay or inaccuracy of e- mails or internet transmission or other communication equipment or facilities. For the avoidance of doubt, EZ-Link shall not be responsible for any losses suffered whether direct, indirect, consequential, or special loss, even if EZ-Link shall have been advised of the same.
  10. You agree that you will not hold EZ-Link responsible for any consequences that may arise as a result of any online communication between you and EZ-Link which may be lost in transmission (whether in whole or in part).
  11. You acknowledge and agree that EZ-Link shall have the right to amend any term(s) of this agreement at any time by giving such notice in writing to the customer, whether by mail, facsimile, e-mail notification or otherwise or by notices at EZ-Link’s website, and your continued subscription to the Service will constitute your agreement to the amendment(s).

Auto Top-Up for Upgraded EZ-Link cards

Terms and Conditions for the Use of EZ-Link Auto Top-up Service for Upgraded EZ-Link Cards

1       DEFINITIONS AND INTERPRETATION

 

1.1        The Auto Top-up Service referred to in this terms and conditions (“Terms and Conditions”) shall be applicable to any upgraded EZ-Link branded cards issued under the Conditions of Issue and Use for EZ-Link Card. This Auto Top-up Service shall not apply to any CEPAS compliant EZ-Link card unless the said card has been upgraded.

1.2        In these terms and conditions (“Terms and Conditions”), the following words and expressions shall have the meaning ascribed to them: “Account” means any Auto Top-up account which has been registered by the Account Holder to enable EZ-Link to make deductions from the Source of Funds in respect of the provision of the Auto Top-up Service.“Account Holder” in relation to any Account means the person to whom the Account belongs to.

  • “Application” means the application of the Auto Top-up Service and includes any such form that may be submitted via the EZ-Link Mobile App or other electronic means for purposes of application for the Auto Top-up Service.
  • “Auto Top-up Enabled Card” means any Card that is enabled by the Account Holder with the Auto Top-up Service.
  • “Auto Top-up Service” means the auto top-up service provided by EZ-Link where Cards are revaluated automatically for the Pre-selected Top-up Value (or multiples thereof) where the Stored Value is insufficient to complete the purchase, and which is paid for by the Account Holder through the debiting of payments from the Account.
  • “Card Holder” means the person bearing and using the Auto Top-up Enabled Card.
  • “Card” means the card (whether physical or digital) issued by EZ-Link and used by the Card Holder for the payment of goods and services, and for the purposes of these Terms and Conditions, refer to cards which have been enabled with the Auto Top-up Service.
  • “EZ-Link” means EZ-Link Pte Ltd a company incorporated in Singapore providing the Auto Top-up Service.
  • “EZ-Link Mobile App” means the EZ-Link mobile app that may be used by the Account Holder for  enabling and managing Auto Top-up related services.
  • “Funding Institution” means the bank, financial institution or entity that issues or operates the Source of Fund.
  • “Pre-selected Top-up Value” means the amount that is pre-selected by the Account Holder to be Revalued on the Card for each Auto Top-up transaction.
  • “Revalue” or “Revaluation” means adding the Revaluation Amount to the Card.
  • “Revaluation Amount” means the amount specified by the Account Holder to be charged to his Account for the purposes of revaluating Auto Top-up Enabled Cards issued to Card Holders.
  • “Source of Funds” means any source of funds accepted by EZ-Link and linked to the Account for the purposes of funding the Auto Top-up Service, which include –
      • payment card branded by VISA or MasterCard as may be accepted by EZ-Link;
      • DBS bank account deduction via GIRO; and
      • any other electronic wallets or accounts accepted by EZ-Link.“Stored Value” means the residual value remaining on the Card.“Threshold Value” means that the Stored Value of the Auto Top-up Enabled Card has reached such amount determined by EZ-Link as applicable for the relevant Card for triggering an Auto Top-up.
  • “Ticket Office” means the ticket sales office located in MRT Stations and Bus Interchanges operated by TransitLink.
  • “TransitLink” means Transit Link Pte Ltd, a company incorporated in Singapore and appointed by EZ-Link to provide card related services.

1.3        Words importing the singular shall include the plural and vice versa, words importing a gender shall include every gender.

1.4        The Terms and Conditions for Auto Top-up Service is in addition to and shall be read in conjunction with the Conditions of Issue and Use For ez-link Cards issued by EZ-Link. The Conditions of Issue and Use For ez-link cards are available at EZ-Link’s website at www.ezlink.com.sg.

 

2       CONDITIONS OF ISSUE

 

2.1        The Account Holder may register for Auto Top-up Service for a Card by submitting the Application using the EZ-Link Mobile App or such other electronic means approved by EZ-Link from time to time. Upon approval by EZ-Link, the Card(s) nominated by the Account Holder will be enabled with the Auto Top-up Service. The Account Holder may nominate up to a maximum number of  Cards (such number to be determined by EZ-Link) to be linked to each Source of Funds for the Auto Top-up Service. EZ-Link shall not be obliged to approve any Application and shall not be obliged to furnish any reasons for any rejected Application.

 

2.2        In consideration of provision of the Auto Top-up Service by EZ-Link, the Account Holder hereby agrees:

    • that the Terms and Conditions shall be binding on the Account Holder in respect of all matters in relation to the use of the Auto Top-up Enabled Card;
    • that the Account Holder shall ensure that Auto Top-up Enabled Card(s) shall only be used by persons authorised by the Account Holder;
    • that the Account Holder shall be responsible for any usage transactions or Auto Top-ups performed on any Auto Top-up Enabled Card(s);
    • that in the event the Stored Value of the Auto Top-up Enabled Card reaches a low value threshold as determined by EZ-Link, the Account Holder authorises EZ-Link to request from the Funding Institution a deduction from the Account the amount to be applied towards any pending Revaluation, and upon successful deduction thereof, to effect the Revaluation onto the Auto Top-up Enabled Card. The Account Holder agrees that EZ-Link shall not effect the Revaluation where EZ-Link is unable, for any reason whatsoever, to make a successful deduction from the Account.
    • that EZ-Link shall be entitled to deduct from the Account any monies owing to EZ-Link in respect of any Revaluations done on any Cards nominated by the Account Holder;
    • that EZ-Link shall be entitled to terminate the Auto Top-up Service in relation to any Cards nominated by the Account Holder where the Account Holder is in breach of these Terms and Conditions;
    • that EZ-Link shall be entitled to blacklist or otherwise invalidate any Auto Top-up Enabled Card where the Account Holder is in breach of these Terms and Conditions. This shall include but not limited to EZ-Link blacklisting and terminating the Card; and
    • that the Account Holder such provide such correct and accurate personal information in such manner as may be required by EZ-Link in the Application.

 

2.3        Notwithstanding anything to the contrary herein contained, EZ-Link may impose a limit on the number of Revaluations per day for each Auto Top-up Enabled Card.

2.4        The Account Holder may via the EZ-Link Mobile App authorize and enable multiple Auto Top-ups of the Pre-selected Top-up Value in a single payment transaction to enable sufficient funds for a payment.

 

2.5        The Account Holder acknowledges that in the event that the Auto Top-up is successfully triggered the Account Holder shall be liable to pay for the Revaluation Amount credited to the Stored Value of the Card.

 

3              CONDITIONS OF USE

 

3.1        The Account Holder hereby undertakes as follows:

    • to ensure that the Terms and Conditions contained herein and in the Conditions of Issue and Use For ez-link Cards are adhered to by the Card Holder where applicable;
    • to ensure that the Source of Funds is valid and there are sufficient funds or sufficient credit limit in the Source of Funds at all times in order to meet deductions by EZ-Link pursuant to the Auto Top-up Service and in accordance with this Terms and Conditions;
    • to inform EZ-Link immediately of any closure or termination of the Account or change in the Source of Funds that may prevent EZ-Link from deducting from the Source of Funds the applicable Revaluation Amount for each Revaluation;
    • to provide EZ-Link with any information as may be reasonably requested by EZ-Link in relation to the issue, use and cancellation of the Auto Top-up Enabled Card, and the termination of the Auto Top-up Service, and to render any and all necessary assistance to EZ-Link and/or any agents appointed by EZ-Link in relation to any investigation relating to the use of the Auto Top-up Enabled Card;
    • to instruct EZ-Link to terminate the Auto Top-up Service prior to the closure or termination of any Source of Funds; and
    • save where the Auto Top-up Enabled Card has been reported lost and cancelled in accordance with paragraph 6.2, to be responsible for all transactions, including any Revaluation, made by the use or purported use of the Auto Top-up Enabled Card by any person whether with or without the knowledge or consent of the Account Holder.

 

3.2        The Account Holder agrees and acknowledges that:

    • The Auto Top-up Service will only be effected when the Application has been successfully approved by EZ-Link;
    • Upon the Auto Top-up Service being activated, the Account Holder will be liable for any Auto Top-up on any Auto Top-up Enabled Card until such time that the Account Holder has either successfully terminated the Auto Top-up Service via the EZ-Link Mobile App or informed EZ-Link to terminate the Auto Top-up Service in accordance with paragraph 7.1.

 

4       PAYMENT

4.1        In the event that EZ-Link fails to receive payment for the Auto Top-up Service in respect of any Revaluation for any reason whatsoever, EZ-Link shall have the right to do any or all of the following:

    • Recover from the Account Holder the outstanding Revaluation Amounts plus all costs incurred (including legal costs on a full indemnity basis) for the recovery of payment from the Account Holder to EZ-Link. In addition, EZ-Link shall be entitled to recover any outstanding amounts due from the Account Holder via deduction from the remaining value contained in any other EZ-Link product (“Associated Card”) registered under the Account Holder.
    • For the purpose referred to in paragraph 4.1.1, EZ-Link shall have the right to suspend the use of and/or terminate the use of the Auto Top-up Enabled Cards or any Associated Card.
    • Terminate the Auto Top-up Service pursuant to paragraph 7.2.2;
    • Disqualify the Account Holder from applying for, being considered for and/or successfully accepted under the Auto Top-up Service for any new Cards for such length of time as may be determined to be appropriate by EZ-Link; and
    • Deduct or set-off any monies owing to EZ-Link or any merchant from the remaining value in respect of any Auto Top-up Enabled Cards issued or held in respect of that Account or the Account Holder.
    • EZ-Link shall contact the Account Holder to arrange to refund of any excess money (free of interest) remaining in the Auto Top-up Enabled Cards after recovery of all monies owing to EZ-Link.
    • EZ-Link shall not be obligated to bear the cost of any replacement Card where the Auto Top-up Enabled Cards has been terminated under this Terms and Conditions.

 

5              LIMIT OF LIABILITY

 

The provisions relating to exclusion of liability in the Conditions of Issue and Use For ez-link Cards shall apply in full to the use of any Auto Top-up Enabled Cards.

 

6              LOSS OF CARD

 

6.1       It is the responsibility of the Account Holder to either block the usage of any lost Auto Top-up Enabled Card (“Lost Card”) via the EZ-Link Mobile App or report the loss of any Lost Card to EZ-Link at its hotline at telephone number 6496 8300 during the hours of 8.00 am to 6.00 p.m. (daily except public holiday). In the event that the Lost Card is discovered outside of the hotline operating hours, the Account Holder may leave a voice mail reporting the loss with the above details.  EZ-Link will attend to the loss report the next working day.

 

6.2       EZ-Link shall cancel the Lost Card within 48 hours after a Lost Card has been reported in accordance with paragraph 6.1. EZ-Link shall refund to the Account Holder the remaining Stored Value on the Lost Card (if any) within 4 weeks of the date of cancellation. EZ-Link shall not be liable to refund to the Account Holder for any monies deducted from the Lost Card within the period of 48 hours after the Lost Card has been reported lost, whether such deductions from the Lost Card were made with the Account Holder’s or Card Holder’s knowledge or consent or not.

 

6.3        Until the expiry of 48 hours after a Lost Card has been reported, the Account Holder shall be liable for any Revaluation to the Lost Card via the Auto Top-up Service as well as any deductions incurred on the Card, and EZ-Link shall be entitled to recover from the Source of Funds for the Revaluation performed.  Where the Account Holder fails to disable the usage of the Auto Top-up Enabled Card via the EZ-Link Mobile App, or fails to a lost report of any Lost Card to EZ-Link, the Account Holder shall continue to be liable for any deductions incurred or Revaluation occurring on the Lost Card, whether with or without the Account Holder’s knowledge or consent.

 

6.4        The Account Holder shall not be liable for any Revaluation or deductions made on the Lost Card after the expiry of 48 hours from the time of disabling of the use of the Lost Card via the EZ-Link Mobile App or loss report of the Card.

 

6.5        Where the loss of an Auto Top-up Enabled Card has been reported, the Account Holder or Card Holder will have to re-apply for the Auto Top-up Service for the replacement Card.

 

7          TERMINATION OF AUTO TOP-UP SERVICE

 

7.1        The Account Holder may terminate the Auto Top-up Service via the EZ-Link Mobile App or via such other means as may be authorised by EZ-Link. Auto Top-up. The Account Holder shall pay all outstanding monies payable to EZ-Link prior to termination of the Auto Top-up Service. However, termination of the Service is not allowed while an outstanding debit Amount is pending.

 

7.2        EZ-Link reserves the right to immediately terminate the Auto Top-up Service without written notice to the Account Holder and the Bank in the event that:

    • there is a breach by the Account Holder or Card Holder in respect of any of the Terms and Conditions contained herein;
    • there is a failure to receive payment of monies owing to it as provided in paragraph 4;
    • the Account of the Account Holder is no longer valid; or
    • EZ-Link is unable to successfully deduct the Revaluation Amount and/or Convenience Fee from the Account.

 

7.3        Upon termination of the Auto Top-up Service howsoever, the Auto Top-up Service shall be disabled on the Card, and:

    • Any and all monies due and owing to EZ-Link by the Account Holder in relation to the terminated Auto Top-up Enabled Card shall be paid within 2 weeks of the date of notification by EZ-Link (as the case may be) of the amount due and owing; and
    • Provided that EZ-Link shall have the right to set-off any monies owing to it from such remaining Stored Value of the Auto Top-up Enabled Card and/or Associated Card(s).

 

7.4       Where the Account Holder owes any amount to EZ-Link in respect of the Auto Top-up Service services provided by EZ-Link, EZ-Link may in its discretion reject any further application to register any Card for Auto Top-up Service until any amounts owing has been paid in full.

 

8          REFUND FOR SURRENDERED AUTO TOP-UP ENABLED CARDS

 

8.1        Account Holders who wish to surrender any Auto Top-up Enabled Card can do so at TransitLink, any Ticket Office or any other locations or channels designated by EZ-Link from time to time.

 

8.2       Any remaining value on the Auto Top-up Enabled Card, based on the amount as determined from EZ-Link’s computer records, will be refunded free of interest to the Account Holder within 14 working days of the date of surrender to the original Source of Fund.

 

9          AMENDMENT

 

EZ-Link may from time to time amend any part of these Terms and Conditions as EZ-Link thinks fit. EZ-Link may give notice of any amendment by posting the amended Terms and Conditions at EZ-Link’s website (www.ezlink.com.sg). The Card Holder agrees that any notification of amendments as aforesaid shall be sufficient notice for the purpose of this paragraph. The continued use of the Auto Top-up Enabled Card after the date of such notification shall constitute an affirmative acknowledgement by the Account Holder of the amendments and shall be deemed to be the Account Holder’s acceptance of such revised Terms and Conditions.

 

10         NOTICES

 

Unless otherwise provided herein all notices, demands or other communications by EZ-Link to a Account Holder shall be deemed served if sent –

 

10.1      by SMS to the Account Holder’s last known mobile number; or

 

10.2      by email to the Account Holder’s email.

 

 

11         NO WAIVER

 

No failure or delay on the part of EZ-Link or its agents in exercising any power right or remedy under the Terms and Conditions shall operate as a waiver of such power right or remedy, nor shall any single or partial exercise of any power right or remedy preclude the further or other exercise thereof, or the exercise of any power right or remedy which it may have.

 

12         RIGHT OF THIRD PARTIES

 

A person or entity who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Terms and Conditions.

 

13         LAW

 

The Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore.  The Account Holder hereby submits to the exclusive jurisdiction of the Singapore courts.

Card Blocking Service

Card Blocking Service Terms & Conditions

You agree to be bound by these terms and conditions (and as varied from time to time) in order to enjoy the benefits of the ‘Card Blocking’ Programme.

General

  • EZ-Link’s ‘Card Blocking’ Programme (“CARD BLOCKING”) is operated by EZ-Link Pte Ltd (“EZ-Link”) and is available to ez-link cardholders. “Programme Participants” are organizations or merchants which extend a benefit, discount or other offer to users of the Programme.
  • CARD BLOCKING Programme is offered by EZ-Link at its sole discretion and is available only to valid ez-link cardholders.
  • EZ-Link may amend these terms and conditions, as well as vary, suspend or terminate the CARD BLOCKING Programme at any time and for any reason, without prior notice to you. We will post any changes to these terms and conditions on the CARD BLOCKING Programme web site. You should therefore review the terms and conditions periodically for changes, and your continued use of the CARD BLOCKING Programme shall constitute acceptance of any changes to the terms and conditions, or the CARD BLOCKING Programme.
  • The CARD BLOCKING Programme consists of different benefits, privileges and services, and specific terms and conditions apply to each. You are advised to read them carefully.

 

Registration

  • To qualify for the CARD BLOCKING Programme, you will need to register as a Member. You can do so via the following channels:
    1. through the EZ-Link Mobile App which you can download onto your iPhone or Android smart phone; or
    2. through our online portal at www.ezlink.com.sg/cardblocking
  • In order to enjoy the full benefits of the CARD BLOCKING Programme, you will need to enter your personal information accurately and completely including your NRIC/FIN, mobile number, Date of Birth and nominated ez-link card(s) (“card”). The personal information are required by us to verify your identity and to enjoy the protection under the CARD BLOCKING Programme so you are advised to ensure that the personal information keyed in is accurate and complete. Please refer to our Member Privacy Policy below to be assured how personal information provided by you will be handled.
  • You may also opt to do a partial registration at participating merchants’ payment terminals. However, the partial registration is only valid for a one-time redemption of benefit/discount from the particular merchant, and does not entitle you to the full suite of benefits under the CARD BLOCKING Programme.
  • You may register up to 3 ez-link cards at any point in time under the CARD BLOCKING Programme. You may register or deregister your card at any time via the EZ-Link Mobile App or at our online portal. You agree that you will register cards which belong to you. Only cards which are registered are eligible for the benefits under the CARD BLOCKING Programme.

 

Card Blocking for Lost Card

  • You are entitled to enjoy our Card Blocking service for lost cards which have been registered under the CARD BLOCKING Programme. If your card is lost or stolen, you may request for your card to be blocked and any remaining stored value to be refunded to you.
  • Please note that as the card is a stored value card, it is not possible to block the card from immediate use at the point of loss reporting. As such, the Card Blocking is on a “best effort” basis, and we do not warrant that any or all remaining stored value will be recovered and refunded. We will not be responsible for any usage or deduction of stored value on your card pending the completion of the Card Blocking process.
  • Before making the loss report, we advise that you should be sure that your card is lost or otherwise not recoverable. Once the card is blocked, it will be permanently invalidated and cannot be re-activated or used even if the lost card is recovered. We only provide a card blocking service and we will not provide you with any replacement card for any lost or stolen card. Please call our customer hotline at 6496 8300 to make your card loss report.
  • You will also need to file a police report and submit it to customerservice@ezlink.com.sg within 7 days after you report the card loss before we can proceed with the refund of the remaining stored value of the lost cards. If we fail to receive the police report within 7 days, your refund request will be terminated automatically.
  • For your protection, you will be asked to provide verification of personal information provided during your registration of the CARD BLOCKING Programme. We will not accept any loss report if the verification details do not match the personal information previously provided.
  • You will need to nominate a pre-existing ez-link card registered with the CARD BLOCKING Programme or to register a new ez-link card with the CARD BLOCKING Programme to enable the refund within 7 days. We will notify you on the status of the Card Blocking within 1 month from the date you nominate or register a replacement card.
  • Upon notification by us, you will need to proceed to any AXS Station to tap and update/synchronize your nominated card to complete the transfer of recovered stored value from your lost card(s) onto your new card. You will need to update/synchronize your card at any AXS Station to complete the transfer of remaining stored value within 90 days failing which your claim will expire and have no further right to claim the refund of the remaining stored value. Information on convenient locations of AXS Stations are available at www.axs.com.sg.
  • If you are also a customer of our EZ-Reload by Card or EZ-Reload by GIRO facility, the terms and conditions applicable to the respective facilities will still apply. Please refer to www.ezlink.com.sg on the terms and conditions applicable, including your rights and obligation relating to blocking of lost cards. Please note that for EZ-Reload by Card or EZ-Reload by GIRO customers, any recovered stored value recovered will be refunded instead back to your credit/debit card account or bank account, as the case may be. However, EZ-Reload by Card or EZ-Reload by GIRO customers would still have to register or nominate another ez-link card with the CARD BLOCKING Programme to continue enjoying the CARD BLOCKING Programme benefits and if they invoke their right to the free insurance cover.

 

Complimentary Lost Card Protection 

  • Upon registration for the CARD BLOCKING Programme, you will automatically be extended complimentary lost card protection from FWD Singapore Private Limited (“FWD”) against unauthorized usage on your registered card that has been reported lost or stolen. The protection is up to $15.00 of unauthorized usage, and you will only be eligible to get this benefit once in a year in relation to one of your registered ez-link cards, regardless of the number of ez-link cards registered.

 

You should note the following:

  • You will be able to claim up to S$15.00 for any unauthorized usage of your registered card. Unauthorised usage will be the amount that is used on the card from the time you notify EZ-Link of the lost/stolen card, up to the time that EZ-Link successfully blocks the card within 48hours.
  • You need to take reasonable care so that registered card is not left unattended.
  • You have to nominate a new EZ-Link card which will be credited of the misused amount.
  • The benefit under this program will be paid to the person who is registered under the CARD BLOCKING program.
  • Your personal information will be shared with FWD for the purpose of servicing you under the protection programme.
  • With your consent your personal information will be shared with FWD for marketing or promotion of FWD’s services or products.
  • FWD reserves the right to terminate your protection under the program at any time by giving you 1 months’ notice by sending it to your email.

 

How to receive the benefit:

Please call EZ-Link customer hotline at 6496 8300 to make your loss report and to activate Card Blocking service. You will also need to file a police report and submit it to customerservice@ezlink.com.sg within 7 days after you report the card loss before we can process the benefit under the program. You will need to nominate an ez-link card by providing the CAN ID in the Card Blocking portal within 7 days for the claim to be processed. For any successful claim, you will need to update/synchronise the refund into your nominated card to complete the transfer of the remaining stored value within 90 days.

Transaction History

  • Members will be entitled to view the detailed transaction history for registered cards displayed, which are for 90 transactions up to the past 2 months. While we strive to make the information as accurate as possible, this is subject to information updated or accurately provided by merchants and/or public transport operators. We do not warrant the accuracy of any information provided under the CARD BLOCKING Programme.

 

Member Privacy Policy

  • We respect your privacy and will take reasonable measures to ensure that your personal information provided will not be disclosed to third parties. We do not sell your personal information to any third parties.
  • We may for the purposes of marketing offers provided by merchants send you such offers via SMS, emails, letters or telephone calls. We will however, not provide any personal information to these merchants unless you have agreed to do so.
  • We may also contact you from time to time to inform you of new products and services offered by EZ-Link.
  • We may use third parties for the fulfillment of our obligations hereunder. However, except as set out in this Member Privacy Policy, we will not disclose any personal information without your permission unless we are legally entitled or required to do so (for example, if required to do so by legal process or for the purposes of prevention of fraud or other crime or as required by government agencies) or if we believe that such action is necessary to protect and/or defend our rights, property or personal safety and those of our users/customers etc.

 

Miscellaneous

  • By registering for the CARD BLOCKING Programme or otherwise using the benefits provided, you are deemed to have agreed that:
    1. you are the owner of the card(s) that you intend to register for the service;
    2. you are aware that the Transaction History may not be accurate or up-to-date due to delays, omissions, inaccuracies or other problems;
    3. all information and data provided is on an “as in” basis and you rely on information provided at your own risk;
    4. all information and data provided is not to be used as evidence or transport claim purposes
    5. save as expressly stated, we make no warranties, express or implied regarding the CARD BLOCKING Programme or information provided; and
    6. EZ-Link shall not be liable for any damages or loss arising from the providing of the services under the CARD BLOCKING Programme or failure of availability of the services under the CARD BLOCKING Programme.

Account-based Concession Cards

ACCOUNT-BASED CONCESSION CARD – TERMS AND CONDITIONS 

CONDITIONS OF ISSUE AND USE FOR EZ-LINK CARD

These Conditions shall be binding on all persons (“Customer“) to whom EZL has issued an ez-link card (”ez-link Card“) as well as any Customer who purchases or otherwise procures and uses an ez-link Card.  These Conditions are published by EZL jointly with Citibank and govern the possession and use of the ez-link Card that may be used to effect transactions.  These Conditions shall apply to any ez-link card as well as any Account Based Concession Card.

 

These Conditions shall also govern the purchase and use of any Form Factor sold or distributed by EZL or any party authorised by EZL, and/or the subsequent use thereof by the Customer shall be deemed to be acceptance by the Customer of these Conditions and any revisions to these Conditions.

 

  1. ISSUANCE OF EZ-LINK CARD

 

  • The ez-link Card is issued by EZ-Link Pte Ltd (“EZL”).

 

  • EZL is the party that issues the ez-link Card, and Citibank Singapore Limited (“Citibank”) is the Bank appointed by EZL to safeguard the monies deposited by Customers into the ez-link Both EZL and Citibank have undertaken to be fully liable to Customers for the monies in the ez-link Card.

 

  • EZL operates the ez-link Card in respect of the Customer’s use of the ez-link Card in accordance with these Conditions. The ez-link Card is distributed by EZL and/or EZL’s agents (“Agents”). The money advanced by the Customer for the ez-link Card or for topping up of the ez-link Card, as the case may be, is collected by EZL and/or the Agents for and on behalf of EZL.

 

  • For the purposes of these Conditions:-

 

“Account-Based Concession Card” shall mean any card issued by EZL for the purposes of identifying persons entitled to concessionary travel by Transport Operators/ LTA, and includes:

  • Child Concession Card (“Child Card”)
  • Primary (MOE) Student Concession Card (“Primary (MOE) Card”);
  • Primary (Non-MOE) Student Concession Card (“Primary (Non-MOE) Card”);
  • Secondary/Pre-U (MOE) Student Concession Card (“Secondary/Pre-U (MOE) Card”);
  • Secondary/Pre-U (Non-MOE) Student Concession Card (“Secondary/Pre-U (Non-MOE) Card”);
  • Diploma Student Concession Card (“Diploma Student Card”);
  • Undergraduate Concession Card (“Undergraduate Card”);
  • Cards issued by Private Education Institutions (PEIs) registered with the Committee for Private Education (“PEI Student Card”);
  • National Service Full-time Concession Card (“NSF Card”);
  • PAssion National Service Full-time Concession Card (“PAssion NSF Card”);
  • Senior Citizen Concession Card (“Senior Citizen Card”);
  • PAssion Silver Concession Card (“PASC Card”);
  • Adult Monthly Travel Card (“AMTC”);
  • Workfare Transport Concession Card (“WTC Card”); and
  • Persons with Disabilities Card (“PWD Card”)

 

Account-Based Concession Card Holder” shall mean the person to whom the concession privilege is granted and whose name and NRIC or Birth Certificate number is printed on the Account-Based Concession Card or recorded electronically in the Account-Based Concession Card.

 

Authorised Person” shall mean such person authorised in writing by EZL to carry out such function as referred to in these Conditions.

 

Bank” shall mean the bank appointed by EZL to undertake to be fully liable for the monies on the ez-link Card, and for the purposes of these Terms and Conditions shall refer to Citibank Singapore Limited.

 

Card Holder” shall mean the person in possession of the ez-link Card or otherwise entitled to use the ez-link Card, including Concession Cardholders unless otherwise stated.

 

Concession Card Holders” shall mean card holders holding an Account-Based Concession Card.

 

ez-link Card” refers to a Form Factor which is linked and can be used to access a Wallet, and which are sold or made available under EZL’s brand name “ez-link” that allows the Customer to make payment transactions at Qualified Merchants, and which includes Account-Based  Concession Cards.

 

Fare Debt” shall mean any amount owing by a Card Holder arising from the shortfall of monies in the ez-link Card to cover the Fares incurred.

 

Fares” shall mean the amount payable to the Transport Operators for the provision of Transit Services.

 

Form Factor” shall mean any ez-link Card in any form, whether physical or virtual, which is sold or made available under EZL’s brand name “ez-link”, whether sold by EZL or its authorized parties, whereby Customer can access the Wallet in order to make payment of Qualified Goods and Services, as allowed by EZL.  The Form Factor shall include but is not limited to e-wallet, cards, mobile SIM cards, novelty pieces, mobile communication devices and other electronic devices.

 

monies” shall mean the monies paid for and/or stored in a Wallet (or the residual value remaining therein from time to time) linked to an ez-link card. This excludes the cost of any Form Factor.

 

“LTA” means the Land Transport Authority of Singapore, a statutory body formed under the Land Transport Authority of Singapore Act (Cap. 158A).

 

Minimum Travel Value” means the minimum Stored Value remaining in the ez-link Card that is required to commence a public transport trip.

 

“PSC” shall mean “Passenger Service Centre” located at MRT station or bus interchange.

 

Passes” shall mean an electronic product offered by TransitLink or Qualified Merchants designated by LTA, that can be encoded onto specific concession card to confer concessionary travel at a fixed pricing on specific Public Transport System modes.

 

PTC Act” shall mean the Public Transport Council Act (Cap.259B) as amended from time to time.

 

Public Transport System” shall mean the public bus and rail systems from time to time operated by the Transport Operators.

 

Qualified Goods and/or Services” shall mean the goods sold and/or the services rendered by Qualified Merchants.

 

Qualified Merchants” shall mean persons approved by EZL and/or Authorised Persons to be engaged in the sale of the Qualified Goods and/or the provision of Qualified Services.  Qualified Merchant shall be authorized by EZL to accept the ez-link Card as a means of payment for such Qualified Goods and/or Services and may include but not be limited to public transport operators licensed by the relevant authorities in Singapore (“Transport Operators”).

 

Stored Value” shall mean the initial monetary value paid for and stored in an ez-link Card, including by means of a Top-up, or the residual value remaining therein from time to time (excluding the Card Cost (as defined hereinafter), which may be used by an ez-link Card Holder for the payment of Transit Services and/or Qualified Goods and/or Services.

 

Ticket” shall mean an ez-link card which is issued as a form of authorisation for the conveyance of any passenger on the Public Transport System, as understood within the context and meaning of the PTC Act.

 

“TLCCRO” shall mean TransitLink Concession Card Replacement Office.

 

TransitLink” shall mean Transit Link Pte Ltd, its successors and assigns.

 

“TLTO” shall mean TransitLink Ticket Office.

 

Transit Services” shall mean the services from time to time provided by the Transport Operators for or in connection with the transportation of passengers on the Public Transport System.

 

Transit Ticketing Machines” shall mean any devices located at MRT stations and bus interchanges that are used to provide ticketing services.

 

Wallet” refers to a stored value account issued by EZL which can be accessed using an ez-link Card.

 

 

  1. CONDITIONS OF USE

 

  • All ez-link Cards are issued subject to these Conditions which shall be binding on all Customers.

 

  • The Customer agrees :- (i) to comply with all the notices, guidelines, rules and instructions pertaining to the use of the ez-link Card as issued by EZL from time to time, including operating rules and/or policies that may be published from time to time by EZL; (ii) to abide by all applicable laws and regulations in the use of the ez-link Card; (iii) not to tamper or allow anyone to tamper with the ez-link Card; (iv) to use the ez-link Card only as a means of payment for Qualified Goods and/or Services; (v) not to intentionally deface, damage and/or destroy the ez-link Card; (vi) to take proper care of any ez-link Card and not to alter, remove and/or replace any notices, trademarks, trade names, logos, artwork or designs on the ez-link

 

  • The Customer acknowledges that EZL is the issuer of the ez-link Card and the corresponding Wallet linked to it, and shall hold and be fully liable for all monies deposited by the Customer, and be responsible to the Customer for refunds of any monies when the Customer makes a request for refund. EZL shall meet the Customer’s redemption by making payment to Qualified Merchants who have provided Qualified Goods and/or Services to the Customer. EZL shall be responsible to the Customer for all administrative matters relating to the ez-link Card as contemplated under these Conditions, and EZL may appoint Agents to carry out such functions on its behalf.

 

  • The Customer also acknowledges Citibank has undertaken to be fully liable as the Bank to the Customer in respect of monies in the ez-link

 

  • The use of an ez-link Card as a means for the payment of fares in the Public Transport System shall be subject always to these Conditions and the “Conditions of Issue and Use for Stored Value Cards” published on the TransitLink website, which shall prevail over these Conditions in the event of any conflict or inconsistency.

 

  1. VALIDITY OF THE EZ-LINK CARD

 

  • Subject to paragraph 3.6, an ez-link Card is valid for use for 5 years from the date that it is encoded for use by EZL (the “Validity Period”), and thereafter the ez-link Card shall expire (“Expiry Date”). The validity of the ez-link Card may also be shorter or longer than 5 years as may be notified by EZL or TransitLink to the Customer at the point of sale/issuance  of any ez-link Card in any product packaging or otherwise at the point of  issuance of the ez-link Card.  EZL may in its discretion and from time to time extend the Validity Period for any or all types of ez-link Cards.

 

  • EZL or its appointed agent TransitLink may at its discretion blacklist any ez-link Card where :

 

  • the ez-link Card is suspected of being counterfeited, stolen, lost, tampered with or fraudulently issued or procured; or

 

  • the monies have been fraudulently or illegally Top-up or otherwise accessed; or

 

  • the ez-link Card is or are otherwise suspected of being faulty, damaged or invalid for use.

 

  • In the event that the Stored Value in the ez-link Card is less than the Minimum Travel Value applicable to the ez-link Card, the ez-link Card will be blocked from usage. The Customer shall be required to Top-up the blocked ez-link Card, and acknowledges and understands that there may be some system delay before the blocked ez-link Card is enabled for payment.

 

  • Where any ez-link Card has been blacklisted, the Customer shall not be entitled to use the ez-link Card, and the monies shall not be refunded to the Customer except with the approval of EZL.

 

ISSUE AND VALIDITY OF ACCOUNT-BASED CONCESSION CARDS

 

  • Account-Based Concession Cards shall be issued only to eligible applicants. Details on concession schemes, concession travel rates, Passes, eligibility for concession travel and conditions relating to concession schemes offered by the Transport Operators / LTA are stipulated at transitlink.com.sg.

 

  • An Account-Based Concession Card is not transferable and can only be used by the Concession Card Holder of that Concession Card.

 

  • The extension of the validity period is at the absolute discretion of the respective Transport Operators or LTA. In the case of any Child Card, Primary (MOE) / (Non-MOE) Card, Secondary / Pre-U (MOE) / (Non-MOE) Card, Diploma Student Card and/or Undergraduate Card, the extension shall be subject to the provision of all relevant information by the school or institution concerned. Save as aforesaid, Concession Card Holders may seek the extension of their concession status at any devices that have been approved by LTA for such purpose.

 

  • The use of a Concession Card as a means for the payment of fares in the Public Transport System shall be subject always to these Conditions and such of the terms and conditions as may from time to time be issued by LTA or such other organisation as may be designated by LTA from time to time to govern the use of any contactless payment medium in the Public Transport System, which terms and conditions shall prevail over these Conditions in the event of any conflict or inconsistency.

 

  • A replacement Account-Based Concession Card may be issued subject to such conditions and to the payment of such sums as published on transitlink.com.sg.

 

  1. TOP-UP OF EZ-LINK CARD

 

An ez-link card holder may Top-up their Card from time to time at any Transit Ticketing Machines and any other channels accepted by EZL via cash, NETS (or such other accepted payment modes), up to the maximum amount of $500 or other amount as may be prescribed for such ez-link Card. This excludes the cost of any Form Factor.

 

  1. TRANSACTIONS USING THE EZ-LINK CARD

 

  • The ez-link Card shall and can be used as a means of payment for Qualified Goods and/or Services, subject always to these Conditions.

 

  • EZL, LTA, any Authorised Person, Transport Operators and/or the Qualified Merchants may reject the use of the ez-link Card for payment of Qualified Goods and/or Services if:-

 

  • It is suspected to be a counterfeit; or

 

  • there are insufficient funds; or

 

  • the ez-link Card has been blacklisted; or

 

  • the Validity Period of the ez-link Card has expired; or

 

  • the ez-link Card is suspected to have been fraudulently issued, Top-Up, stolen or tampered with or may in any way pose a risk to the system or prevents the proper deduction of Fares or to evade any Fare payment; or

 

  • the ez-link Card system is unable to process the payment for any reason whatsoever or if a force majeure event or system failure arises which disables and/or prevents the Qualified Merchants from accepting and/or processing the ez-link Card as a means of payment; or

 

  • the ez-link Card is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the system;

 

  • the ez-link Card is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever;

 

  • the ez-link Card has not been activated for use in the Public Transport System.

 

  • an Account-Based Concession Card is used by any person who is not eligible or who has ceased to be eligible for concessionary travel; or

 

  • an Account-Based Concession Card is used by any person who is not the Account-Based Concession Card Holder to whom the Account-Based Concession Card is issued.

 

  • The Customer agrees that each of the Qualified Merchants is responsible for deducting payment for Qualified Goods and/or Services that the Customer has agreed with the Qualified Merchant or is agreeable (with the Qualified Merchant) to pay from the ez-link Card, in such manner as may be required by such Qualified Merchant.

 

  • The Qualified Merchants accepting the use of ez-link Card may be changed from time to time without prior notice.

 

  • Where an ez-link Card which was previously blacklisted (pursuant to paragraph 3.2), is subsequently removed by EZL from the blacklist after the reason for the blacklist has been resolved to EZL’s satisfaction, such ez-link Card may still be temporarily unavailable for use pending the ez-link Card system update, and the Customer agrees and understands that EZL shall not be liable for the non-availability of the ez-link Card during such period.

 

 

  1. QUALIFIED GOODS AND/OR SERVICES OF QUALIFIED MERCHANTS

 

It is expressly acknowledged by the Customer that neither Citibank, EZL nor any Agent is involved in the provision of the Qualified Goods and/or Services offered by any Qualified Merchant accepting the ez-link Card for payment. Neither Citibank, EZL nor any Agent shall be liable in any way for the Qualified Goods and/or Services sold, rendered or provided by the Qualified Merchants (including without limitation any defect, disruption, failure or unavailability of or relating to any of such Qualified Goods and/or Services, as the case may be) or for any other disputes concerning the Qualified Goods and/or Services, all of which shall be the sole responsibility of the Qualified Merchants.

 

 

  1. RETENTION OF ACCOUNT-BASED CONCESSION CARDS

 

  • Notwithstanding any other clause, EZL, LTA, TransitLink, any Authorised Person and/or any of the Transport Operators shall be entitled to seize and retain the Account-Based Concession Card if:

 

  • it is used by a Concession Card Holder who is not eligible or who has ceased to be eligible for concessionary travel;
  • it is used by a person who is not the Concession Card Holder of that Account-Based Concession Card;
  • it has expired;
  • it is suspected by EZL, LTA, TransitLink, any Authorised Person and/or the Transport Operators:
    • to be a counterfeit;
    • to have been fraudulently or illegally issued or Top-up;
    • to have been stolen or tampered with in any way; or
    • to have been used in a manner which illegally or fraudulently hinders or prevents the proper deduction of Fares or to evade any Fare payment;
  • it is damaged, unreadable, defective, faulty or otherwise poses a risk of damage to the Concession Card System;
  • it has been blacklisted for any reason whatsoever;
  • it is not capable or has ceased to be capable of functioning as a Ticket for any reason whatsoever.

 

 

  1. REFUNDS ON THE EZ-LINK CARD

 

  • Subject to paragraphs 3 and 8, a refund of the monies remaining (whether valid or expired) can only be obtained by a Customer if the ez-link Card is presented at any TLTO or TLCCRO at MRT stations and bus interchanges or at such other places or via such other channels as may be designated or authorized by EZL. Refunds may also be effected through such online means as may be determined by EZL. Customers may refer to the EZL website at ezlink.com.sg for the refund channels available. The amount of monies remaining (whether valid or expired) shall be as determined by EZL and/or the Agents and will be refunded free of interest. The ez-link Card shall be returned to the Customer after refund. Notwithstanding the foregoing, EZL or its Agent may require the ez-link Card to be retained for investigations to determine the value of the remaining monies.  Where a refund request requires EZL to conduct investigations, the remaining monies will be refunded upon completion of the investigations.  The remaining monies will be determined based on EZL’s system records. However, no refund of the monies will be made on any expired ez-link Card after 7 years from the Expiry Date whereupon the Customer shall have no claim against Citibank and/or EZL in respect of the monies remaining, whereupon EZL shall be fully entitled to deal with any unclaimed monies as it thinks fit.

 

  • Other than as provided in paragraph 8.1 above, neither EZL nor any of the Agents shall be obligated to make a refund to any Customer or to process any Customer’s request for refund on any ez-link Card (whether valid or expired). Notwithstanding the foregoing provision, each of EZL and the Agents may at their absolute discretion make a refund or process a refund in respect of the monies or any part thereof, and any such refund may be made and/or processed subject to conditions imposed by EZL and/or the Agents on EZL’s behalf. EZL and/or the Agents shall not be obliged to effect an immediate refund, and may, in its absolute discretion, refund the monies on any ez-link Card in such manner and upon due verification as it deems fit.

 

  • In any case, each of EZL and the Agents will not be liable to make a refund of the monies if :-

 

  • the ez-link Card is not surrendered by the Customer at the time of a request for refund or the Customer is otherwise not able to establish proof of ownership; or

 

  • the ez-link Card’s electronic data and its external card number are not available or reliably readable for any reason whatsoever as determined by EZL and/or the Agents; or

 

  • the ez-link Card is altered, tampered, intentionally damaged, or interfered with; or

 

  • the ez-link Card is counterfeited, stolen, lost, tampered with or fraudulently issued or procured;

 

  • the monies is suspected by EZL to have been fraudulently or illegally Top-up; or

 

  • the ez-link Card has a Fare Debt or any other amount owing, until such time the Fare Debt or amount owing has been settled.

 

  • Subject to paragraph 8.5, a Customer shall be entitled to a refund of the monies at any time up to 7 years from the Expiry Date, PROVIDED that where the request for refund was made more than 2 years after the Validity Period, EZ-Link shall be entitled to levy a monthly service charge (“Refund Service Charge”) of S$1.00, for each ez-link Card that is surrendered for refund more than 2 years after the Expiry Period. The Refund Service Charge shall be deducted monthly from the remaining monies commencing 2 years from the Expiry Period until request for refund is made or when the remaining monies is fully depleted, whichever is the earlier.  The Refund Service Charge will not apply to Account-Based Concession Cards.  For the avoidance of doubt, the Customer shall not be entitled to a refund after 7 years from the Expiry Date.

 

  • A Customer who makes a request for refund at the designated places referred to in paragraph 8.1 above shall, upon request, produce such identity document for inspection to verify the identity of the Customer. Each of EZL and the Agents may at their absolute discretion refuse any request for the refund of the monies, if the Customer does not produce his/her identification.

 

  • The Customer shall, upon receipt of the refund, be deemed to have accepted the amount thereof as correct, and agrees to discharge each of Citibank, EZL and the Agents from any liability whatsoever to the Customer, including but not limited to any shortfall or error in the amount of such refund.

 

  • Where the Customer has made a request for refund, and EZL and/or the Agents is required to effect a deferred refund of the remaining monies, EZL and/or the Agent may stipulate a refund collection period of not less than 90 calendar days for the Customer to collect his refund. In the event that the Customer fails or neglects to collect his refund or is otherwise unable to produce proof of the request for refund within the stipulated refund collection period, the Customer shall be deemed to have abandoned his claim to the refund and shall have no further right to claim against EZL for the refund.  EZL shall thereafter have the right to deal with the refund as it deems fit.

 

  • All obligations of Citibank hereunder are payable solely at and by Citibank in Singapore, subject to the laws of Singapore (including any governmental actions, orders, decrees, and regulations).

 

 

  1. DETERMINATION OF VALUE IN WALLET

 

The determination by EZL and/or the Agents as to the remaining monies on a Wallet shall be final and conclusive. For the purpose of such determination, the remaining monies as determined by EZL and/or the Agents from the records of EZL or the information generated by the ez-link Card system shall, save for manifest error, be deemed to be conclusive and binding against the Customer.

 

 

TERMS RELATING TO SALE AND USE OF EZ-LINK CARD

 

  1. EZ-LINK CARD COST

 

  • EZL or its agents or resellers may collect an amount to cover the cost of the ez-link card (“ez-link Card Cost”). The ez-link Card Cost, in the case of a physical card is up to a maximum of S$5.00. The ez-link Card Cost is non-refundable.

 

  • EZL or its agents or resellers may collect from the Customer such amount higher than S$5.00 for the purchase of an ez-link card or other Form Factors.

 

 

  1. REPLACEMENT OF DEFECTIVE EZ-LINK CARD

 

  • Subject to paragraphs 11.2, 11.3, 11.4 below, a Customer may replace a defective ez-link Card (excluding Account-Based Concession Card) by presenting it at any TLTO or TLCCRO at MRT stations and bus interchanges. The monies in the Wallet on the defective ez-link Card shall be refunded to the Customer in accordance with paragraph 6. EZL may specify a minimum amount to be deposited for the Customer to be entitled to receive the replacement Form Factor. The defective ez-link Card shall be surrendered to and retained by EZL and/or the Agent upon such request for replacement.

 

  • Other than as provided in paragraph 11.1 above, neither EZL nor any of the Agents shall be obligated to replace any ez-link Card (whether defective or not). Notwithstanding the foregoing provision, each of EZL and the Agents may at their absolute discretion replace the ez-link Card, and any such replacement may be made subject to conditions imposed by EZL and/or the Agents on EZL’s behalf.

 

  • In any case, each of EZL and the Agents will not be liable to replace the ez-link Card for free as provided in paragraph 11.1 if:-

 

  • the ez-link Card is not surrendered by the Customer at the time of request for replacement; or

 

  • EZL and/or the Agents in its discretion determine that the ez-link Card has been damaged whether intentionally or by failure to take proper care of the ez-link Card or otherwise used or handled in breach of paragraph 2.2 herein; or

 

  • the ez-link Card has been de-laminated, peeled, tampered, broken or otherwise damaged due to wear and tear; or

 

  • EZL and/or the Agents are unable to reliably read or ascertain the identification account number associated with the ez-link Card for any reason whatsoever; or

 

  • the ez-link card has a Fare Debt or any other amount owing, until such time the Fare Debt or any amount owing has been settled;

 

  • the Validity Period of the ez-link Card has expired.

 

  • The determination by EZL and/or the Agents as to the amount of monies on a defective ez-link Card shall be final and conclusive (see paragraph 9 above). EZL reserves the right to subsequent adjustments to such determination should any transaction records received late indicate a different value than that determined at the time of replacement.

 

 

  1. CORRUPTED ACCOUNT-BASED CONCESSION CARD

 

  • Concession Card Holders with corrupted, defective or faulty Account-Based Concession Cards shall present such Concession Cards at any TLTO, TLCCRO or PSC immediately after such corruption, defect or fault has arisen.

 

12.2     Temporary Cards which are issued to Concession Card Holders with corrupted, defective or faulty Account-Based Concession Cards are subject to the Conditions of Issue and Use of Temporary Cards published at TransitLink’s website at www.transitlink.com.sg.

 

 

  1. REPLACEMENT OF DEFECTIVE NON-CARD FORM FACTOR

 

EZL does not, unless otherwise expressly stipulated in the terms of sale, provide any product warranty for any Non-Card Form Factor. Where a Non-Card Form Factor purchased from EZL is defective (not through any fault or act of the Cardholder) prior or during the first use for payment or use of the Non-Card Form Factor, EZL or its agents or resellers shall replace the defective Non-Card Form Factor with a similar or like product. Subject to any prevailing law, EZL or its agents or resellers shall not be liable to replace any Non-Card Form Factor that is found to be defective at any second or subsequent use.

 

 

  1. LOSS OF EZ-LINK CARD

 

  • Customers are responsible for safeguarding their ez-link Card against loss, damage or theft, and ensuring that their ez-link Card are not used by any person without the Customer’s permission. Each of Citibank, EZL, the Agents and the Qualified Merchants accepting the Form Factor for payment for Qualified Goods and/or Services are not responsible for any financial losses incurred due to the loss or unauthorized use of an ez-link Card and have no obligation whatsoever to prevent the use of a lost ez-link Card by a person other than the Customer.

 

  • Where EZL and/or the Agents are in possession of any lost ez-link Card, the Customer may reclaim the ez-link Card provided that the Customer is able to produce proof of ownership to the satisfaction of EZL and/or the Agents. Except for Account-Based Concession Cards, Customer shall not have any claim to any lost ez-link Card or the monies therein if the lost ez-link Card remains unclaimed after two weeks in EZL and/or the Agents’ possession. EZL shall be fully entitled to deal with the remaining monies on such lost Form Factor as it thinks fit.

 

  • Card Holder of Account-Based Concession Card who lose their card must immediately report the loss of their card to TransitLink through the TransitLink Hotline or any other channels as may be permitted by EZL for the purposes of invalidation. Once invalidation requests are reported by the Card Holder, these are final and irreversible. The lost card may take up to 48 hours to be invalidated from the time of the request.

 

 

  1. EXCLUSION OF LIABILITY

 

  • Notwithstanding anything to the contrary contained herein, each of Citibank, EZL and the Agents shall not be liable, whether or not arising out of the negligence of each of Citibank, EZL, the Agents and/or their respective officers, employees, or agents, for any losses, damages, expenses, claims, liability and costs (including cost on a solicitor and client basis) that the Customer may incur or suffer in connection with:-

 

  • the use or issue of ez-link Card; or

 

  • any delay in issuing of ez-link Card or suspension or discontinuance of issuing of ez-link Card;

 

  • any period where any equipment, software or system is unavailable for processing the use of the ez-link Card for payment; or

 

  • any delay or detention arising from use of the ez-link Card.

 

  • Damaged or defective ez-link Card may not be accepted in the equipment used by the Qualified Merchants. Neither Citibank, EZL nor the Agents shall be liable for any loss, delay or inconvenience that may be incurred if the ez-link Card is not accepted in such equipment.

 

  • Notwithstanding any other provision of these Conditions, EZL’s total liability to the Customer under these Conditions and at law shall not exceed in aggregate the sum of S$500.00 ez-link Card.

 

  • Citibank’s and EZL’s total liability to a Customer shall not exceed the aggregate of the remaining monies of such Customer’s ez-link Card as of the date the Customer’s claim arises.

 

 

  1. AMENDMENT

 

EZL may (for and on behalf of itself and/or Citibank) from time to time amend any part of these Conditions. EZL will give notice of any amendment by posting the same at its website at www.ezlink.com.sg, , the premises of the Agents and/or such other premises as may be determined by EZL. The Customer agrees that any notification of amendments as aforementioned shall be sufficient notice for the purpose of this paragraph. If the Customer does not accept any amendments, he shall cease all use of the ez-link Card. The Customer’s continued use of the ez-link Card after the date of such notification shall constitute an affirmative acknowledgement by the Customer of the amendments and shall be deemed to be the Customer’s acceptance of such revised Conditions.

 

 

  1. NO WAIVER

 

No failure or delay on the part of EZL in exercising any power, right, or remedy under these conditions shall operate as a waiver of such power, right, or remedy.

 

 

  1. RIGHT OF THIRD PARTIES

 

A person or entity who is not a party to these Conditions shall have no right under the Contracts (Rights of Third Parties) Act, chapter 53B of Singapore to enforce any term of these Conditions, regardless of whether such person or entity has been identified by name, as a member of a class or as answering a particular description. For the avoidance of doubt, nothing in this paragraph shall affect the rights of any permitted assignee or transferee of these Conditions.

 

 

  1. FORCE MAJUERE

 

Neither Citibank nor EZL nor any Agents shall be liable for non-performance, error, interruption or delay in the performance of their obligations under these Conditions, if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond its reasonable control which includes without limitation:- (i) flood, lightning, acts of God, fire, earthquakes and other natural disasters; (ii) judgements, legislation, acts, orders, directives, policies, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any court, governmental, parliamentary and/or regulatory authority imposed or to be imposed after the fact; (iii) power failure; (iv) acts or defaults of any telecommunications network operator; (v) circumstances where communications lines and/or computer systems of EZL, Citibank, the Agents and/or the Qualified Merchants cannot be used for reasons attributable to third party telecommunications carriers; and (vi) acts or omissions of any Qualified Merchant or any party for whom Citibank, EZL and/or the Agents are/is not responsible.

 

 

  1. INDEMNITY

 

The Customer hereby undertakes and agrees to indemnify each of Citibank and EZL and keep each of Citibank and EZL at all times fully indemnified from and against all actions, proceedings, claims, liabilities (including statutory liability), penalties, demands and costs (including without limitation, legal costs of Citibank and/or EZL on a solicitor and own client basis), awards, damages, losses and/or expenses however arising directly or indirectly by reason of and/or as a result of any breach or non-compliance by the Customer of the terms and conditions herein.

 

 

  1. GOVERNING LAW

 

The construction, validity and performance of these Conditions shall be governed by and construed in accordance with Singapore law. Each party mentioned herein hereby submits to the non-exclusive jurisdiction of the Singapore courts.

 

  1. TRANSIT CONDITIONS AND ENFORCEMENT

 

  • The use of the ez-link Card shall be subject to the Transit Conditions.

 

22.2      EZL, the Transport Operators and/or the Agents shall be entitled without assigning any reason therefore to retain any ez-link Card which it reasonably suspects or has reason to believe to have been blacklisted, fraudulently issued, stolen, tampered with and/or used any personalized ez-link Card  (which was not issued to the person using such ez-link Card or which the person is not entitled to the use thereof, or where the ez-link Card has been blacklisted.
